MANILA, Philippines- Dalawang panukalang batas ang inihain sa Senado na naglalayong palawigin ang estate tax amnesty hanggang Hunyo 14, 2025 na papakinabangan ng mamamayan sa pagbabayad sa buwis ng minanang ari-arian pagkatapos mamatay ang may-ari.
Inihain nina Senate President Juan Miguel Zubiri, Senate President Pro Tempore Loren Legarda, at Majority Leader Joel Villanueva ang Senate Bill 2170 habang ikinasa naman ni Senate Committee on Ways and Means chairman Sen. Sherwin Gatchalian ang Senate Bill 2197.
“Aside from extending the period for estate tax amnesty filing, both bills seek to expand the coverage by including the estate of decedents who died on or before December 31, 2021,” ayon sa panukala.
Kabilang sa panukala ni Gatchalian ang probisyon na nagsasabing: “Allows a one-time declaration and settlement of the estate tax by the present holder, heirs, executors, or administrator of the properties subject to multiple unsettled estates or those estates which are still in the name of another decedent or donor—a provision which former President Rodrigo Duterte had vetoed from Republic Act No. 11213.”
Sa ilalim ng SB 2197, ipinanukala din ni Gatchalian na ipagbawal sa Bureau of Internal Revenue na pagsumitehin ang taxpayers ng proof of settlement, kahit judicial o extrajudicial, sa pagkuha ng tax amnesty.
“The stringent requirements that are beyond the provisions of the law cause confusion and reluctance to file on the part of the taxpayers,” giit ni Gatchalian.
Nitong Lunes, inaprubahan ng House of Representatives sa ikatlo at huling pagbasa ang panukalang magpapalawig sa estate tax amnesty ng dalawang taon kaya ibinabasura ang deadline ng application mula Hunyo 14, 2023 hanggang Hunyo 14, 2025.
Sakop sa bersiyon ng Mababang Kapulungan ang nag-aaplay ng estate tax amnesty para sa namatay bago at sumapit ang Disyembre 31, 2017 hanggang Disyembre 31, 2021. Ernie Reyes
