MANILA, Philippines – Nagtanong si dating Supreme Court Chief Justice Artemio Panganiban nitong Miyerkules, Setyembre 16 kung makatarungan bang hayaang makilahok sa botohan ng impeachment trial ang mga senador na nag-e-enjoy sa tourist spots sa abroad o yaong mga nagtatago “in the dark corners of the world,” habang ang iba ay naglalaan ng oras sa pagdinig ng argumento at pagsusuri ng ebidensya.
Si Panganiban, isa sa apat na retiradong mahistrado ng Korte Suprema na inimbitahan ng Senate Impeachment Court bilang amici curiae upang magbigay ng pananaw sa isyu ng voting threshold na kailangan para ma-convict si Vice President Sara Duterte.
Aniya, dapat aktibong lumahok ang mga senador sa proceedings bago gamitin ang kanilang awtoridad na magpasya sa kaso.
Kasama ng prinsipyong ito, tinanong ni Panganiban kung patas bang hayaang bumoto — pabor man sa conviction o acquittal ni Duterte — ang mga hindi dumalo sa paglilitis.
“Thus, the Senate must hear the prosecution and the defense witnesses as it already does, allow their counsels to argue verbally and in writing, and study their presentations deeply,” aniya. “Only thereafter should it issue its orders and decisions. In this connection, is it truthful and fair to allow senators to cast their votes despite being absent from the proceedings?” tanong ni Panganiban.
Kinuwestyon din ni Panganiban kung makatarungan bang payagang bumoto ang mga senador na nasa abroad, nagtatago, nakadetine nang legal, may sakit, naka-hospital, o kaya’y absent, kahit hindi nila na-access at nasuri ang mga dokumento, narinig ang testimonya o naobserbahan ang demeanor ng mga testigo sa paglilitis.
Nagbigay ang dating mahistrado ng ilustrasyon sa pamamagitan ng pagtukoy sa mga senator-judge na maaaring “looking at the pyramids along the Nile,” namimili sa Paris o sumasakay ng gondola sa Venice habang ang ibang miyembro ng impeachment court ay nananatili sa chamber para sa proceedings.
“You are tasked with a constitutional duty that cannot always be reduced to abstract arithmetic, neither can such duty be performed in the shadows of absence nor from legal impediments. As the elective representatives of the Filipino people, your Honors’ mandate in my humble opinion demands a commonsensical interpretation of the Constitution,” aniya.
“Indeed, meaningful adjudication requires active participation in the search for truth and fairness,” dagdag pa niya.
Bukod kay Panganiban, ang iba pang retiradong mahistrado na inimbitahan bilang amici curiae ay sina dating Chief Justices Reynato Puno at Hilario Davide Jr., at dating Associate Justice Adolfo Azcuna. Hinilingan silang magbigay ng kanilang pananaw sa constitutional voting threshold para sa conviction.
Sa ilalim ng Article XI, Section 3(5), binibigyan ang Senado ng “sole power to try and decide all cases of impeachment.” Nakasaad din sa parehong probisyon na ma-co-convict lamang ang isang tao sa “concurrence of two-thirds of all the Members of the Senate.”
Apat na senator-judge ang hindi nakadalo sa malaking bahagi ng trial: sina Jinggoy Estrada at Rodante Marcoleta na nakadetine kaugnay ng magkahiwalay na kasong plunder, si Ronald dela Rosa na absent sa gitna ng arrest order mula sa International Criminal Court, habang si Loren Legarda ay nasa abroad dahil sa medical leave.
Kung hindi isasama ang apat sa voting base, ang two-thirds ng natitirang 20 senador ay magiging 14 na boto. Ernie Reyes
