Kinansela ng Commission on Elections (Comelec) Second Division nitong Biyernes ang registration ng An Waray party-list (PL) dahil sa paglabag sa rules and regulations na may kaugnayan sa botohan noong 2013.
Binanggit ng second division na habang ang An Waray ay unang binigyan ng dalawang puwesto sa House of Representatives noong 2013, binawasan ito sa isang puwesto sa ilalim ng National Board of Canvassers (NBC) pagkatapos ng pagkalkula.
Ayon sa Comelec, pinayagan ang An Waray second nominee na si Lawyer Isabel Noel na umupo bilang kinatawan sa 16th Congress, sa kabila na batid nitong hindi naglabas ang Comelec ng Certificate of Proclamation na nagbibigay-daan para gawin niya ito.
“An Waray allowed its second nominee, lawyer Victoria Isabel Noel, to sit as representative in the 16th Congress, “knowing fully well that the Comelec has not issued a Certificate of Proclamation entitling her to do so,” sinabi ng Comelec.
“The recomputation of seats was made following the Supreme Court’s order, in Abang Lingkod Party-list vs. COMELEC, to proclaim Abang Lingkod PL as one of the winning PL groups in the 2013 NLE with the number of seats it may be entitled to, and in view of the then-pendency of the case of Senior Citizens PL before the Supreme Court,” saad sa resolusyon na inilabas noong Agosto 20, 2014.
Ipinunto din ng Comelec na sa kawalan ng Certificate of Proclamation para sa pangalawang nominado nito, ang An Waray party-list ay may karapatan lamang sa isa, kaya walang legal na batayan ang “assumption to office as Representative of An Waray” ni Noel.
Sinabi ni Comelec spokesperson Rex Laudiangco na ang desisyon ay hindi pa final at executory at ang party-list ay maaring maghain ng motion for reconsideration (MR).
“The resolution has yet to become final and executory. But should it be so, please recall that the primary qualification to be able to participate in the Party List System of Representation Elections is its registration and such qualification must be continually possessed,” saad ni Laudiangco sa mga mamahayag.
Mayroong limang araw ang An Waray upang makapaghain ng kanilang MR sa Comelec en banc. Gagawing final at executory ang desisyon nabigong gawin ito sa loob ng reglementary period.
Ipinaliwanag ni Laudiangco na bagamat ang paglabag ay nangyari sampung taon na ang nakalilipas, may kapangyarihan ang Comelec na silipin ang pagsundo nito sa ilalim ng Party-list Act.
Sinabi ni Laudiangco na habang ang pagkansela sa registration ng partido ay maaaring maging batayan para sa pagtanggal ng puwesto sa Kamara, ang Kapulungan ng mga Kinatawan ang may “ultimate jurisdiction” sa usapin.
“We must always take due notice that when it comes to qualifications, retention a of seat at the House of Representatives of a sitting Member will ultimately will be within the jurisdiction of the House of Representatives Electoral Tribunal,” sabi ni Laidiangco. Jocelyn Tabangcura-Domenden
