MANILA, Philippines- Ipinag-utos ng Court of Appeals (CA) sa Armed Forces of the Philippines (AFP) at sa Philippine National Police (PNP) na ilabas ang dalawang UP alumni na naiulat na nawawala mula noong Abril.
Sa 10-page resolution na may petsang July 10, iginawad ng CA Thirteenth Division ang writ of habeas corpus na inihain ng pamilya at mga kaanak nina Gene Roz Jamil “Bazoo” de Jesus at Dexter Capuyan.
“Finding the instant petition to be sufficient in form and substance and it appearing from the allegations therein that the writ ought to issue, this Court hereby gives due course to the petition and orders the issuance of the corresponding writ,” giit ng appellate court.
Inatasan ng CA ang respondent officials ng PNP na ilabas sina De Jesus at Capuyan “if found in their custody” sa appellate court sa July 14, Biyernes.
Pinagpapaliwanag din ng CA ang respondents kung bakit dapat manatili sina De Jesus at Capuyan sa kanilang kustodiya.
“The Division Clerk is hereby directed to issue summons together with copies of the petition and its annexes to be served upon the respondents… directing them to file their comment to the petition within five days from receipt,” pahayag ng CA.
Kabilang sa respondents sina AFP Chief of Staff General Andres Centino, PNP chief Police General Benjamin Acorda Jr., Rizal Provincial Office Provincial Director Police Colonel Dominic Baccay, at PNP-Criminal Investigation and Detection Group chief Police Brigadier General Romeo Caramat.
Sa kasalukuyan ay wala pang komento ang PNP hinggil dito.
Samantala, sinabi ni AFP spokesperson Colonel Medel Aguilar na tutugon sila kapag natanggap na nila ang court order.
Base sa CA, napag-alaman ng pamilya ni De Jesus na huli siyang nakita sa Taytay, Rizal kasama si Capuyan noong May 2 matapos hindi pumasok sa trabaho noong April 29 nang walang pasabi.
Sinabi ng petitioners na ayon sa nakausap nilang tricycle drivers, may naganap na pagdukot o pag-aresto noong Abril 28.
Sinabi ng isang informant na may lumitaw na mga armadong kalalakihan na nagpakilalang mga miyembro ng PNP-CIDG at binitbit ang dalawang indibidwal na pasok sa paglalarawan kina De Jesus and Capuyan sa magkahiwalay na sasakyan.
Anang kapatid ni De Jesus, naniniwala siya na ang kanyang kapatid ay hawak ng state forces dahil inilathala umano nila sa social media na si Capuyan ay miyembro ng New People’s Army (NPA) at may pending warrants.
Inihayag naman ng University of the Philippines (UP) System nitong nakaraang buwan na sina De Jesus at Capuyan ay kilalang indigenous peoples’ rights activists. RNT/SA
