MANILA, Philippines – Inaprubahan na ng Kamara nitong Lunes, Pebrero 6 sa ikatlo at huling pagbasa ang “Eddie Garcia Bill” na naglalayong protektahan ang mga manggagawa sa entertainment industry.
Lahat ng 240 mambabatas na dumalo sa pagdinig ay bumotong pabor sa House Bill 1270 o ang panukalang “Eddie Garcia Act”.
Ang panukala ay binubuo ng anim iba pang mga hakbang na inakda ni 1PACMAN Rep. Mikee Romero.
Tinukoy na ang isang industry worker o independent contractor ay “any person engaged or hired by the employer or principal to render services involving the production, distribution, and exhibition of film, television, and radio entertainment content.”
Layon ng panukala na ang isang industry worker o independent contractor ay “shall be governed by the provisions of the Civil Code on contracts and other applicable laws, but not lower than the standards provided under Presidential Decree No. 442, or the Labor Code of the Philippines, as amended.”
Dapat din na may kasunduan o employment contract ang isang manggagawa at contractor na naiintindihan ng magkaparehong partido.
Binibigyang mandato rin ng panukala na ang normal work hours ay dapat na walong oras lamang, na maaaring palawigin ng 12 oras kabilang na ang waiting time sa set o sa opisina.
Ang serbisyo rin na sosobra sa 8 oras ay dapat na may kaukulang overtime pay.
Limitado rin dapat sa 60 hours kada linggo ang oras ng trabaho kung saan kasama sa compensable working time ang biyahe para sa mga out-of-town projects.
Dapat din na protektado ng Republic Act No. 9231 o Special Protection of Children Against Child Abuse, Exploitation and Discrimination Act ang mga menor de edad.
Hindi rin dapat umano bababa sa minimum wage sa rehiyon ang matatanggap na sahod ng isang industry worker o contractor.
Sa pahayag, ipinaliwanag naman ni Speaker Ferdinand Martin Romualdez na ang HB No. 1270 ay makatutulong sa libo-libong manggagawa sa entertainment sector.
“It would ensure that they continue to have gainful employment and protect them against abuse, harassment, dangerous working environment, and exploitation,” aniya.
“Manong Eddie was a hugely popular actor well-loved by many Filipinos. It was unfortunate that he died in such circumstances. But the accident served as a wake-up call for the industry and for us policymakers in Congress,” pagpapatuloy nito. RNT/JGC
