MANILA, Philippines- Pinawalang-sala ng Sandiganbayan ang dating alkalde na si Francisco M. Nazareno ong f Moises Padilla town sa Negros Occidental sa kasong graft dahil sa umano’y “unlawful” na donasyon ng munisipalidad sa sarili niyang foundation noong 2013.
Naiulat na pinayagan umano ni Nazareno na ibigay ang donasyon sa Uswag Moises Padilla Development Foundation, Inc. (Uswag) na itinatag niya, na binubuo ng pera, lupa, sasakyan, iba’t ibang gamot at office supplies na nagkakahalaga ng P2.48 milyon.
Subalit, iginiit ng Sandiganbayan na hindi napatunayan ng prosekusyon na nagkasala si Nazareno.
“After evaluating the prosecution’s evidence, all that it was able to establish is that the Sangguniang Bayan of Moises Padilla executed several resolutions that authorized accused to sign memorandum of agreements (MOAs) on behalf of the municipality to facilitate the donations to be made to Uswag, but there is no evidence to prove the actual donations alleged to have been made,” pahayag ng korte.
Dahil walang ebidensya ng pagmamay-ari ng munisipalidad ng donated items, sinabi ng anti-graft court said na hindi masasabing nagkaroon ng “damage”sa munisipalidad dahil sa mga aksyon ni Nazareno.
Ang napatunayan lamang ng korte ay si Nazareno ang alkalde ng Moises Padilla, mayroon siyang direktang interes sa Uswag, at ikinasa niya ang ilang Deeds of Donation pabor sa Uswag, base sa korte.
Subalit, iginiit ng korte na hindi napatunayan ng prosekusyon na mayroong legal effect ang mga dokumento.
“Hence, the fact that the contracts for the donation of real property were void, and that it was not proven that properties said to have been donated were owned by the municipality in the first place prevents a finding of culpability under the Anti-Graft Law,” anang korte.
