Hirit ni Rep. Garin na pagbasura sa Dengvaxia cases tablado sa Sandiganbayan

MANILA, Philippines- Hindi pinagbigyan ng Sandiganbayan ang hiling ni Iloilo Representative Janette Garin na ibasura ang graft at illegal use of public funds cases na isinampa laban sa kanya kaugnay ng Dengvaxia controversy.

Sa nine-page resolution, ibinasura ng Sandiganbayan ang motion to quash criminal information sa basehan ng inordinate delay sa paghahain ng kaso ni Garin at ng kanyang co-accused.

Base sa anti-graft court, kinakailangan ng sapat na oras upang suriin nag reklamo na inisyal na mayroong 42 akusadong indibidwal.

“Considering the circumstances that attended the investigation of these cases – with originally 42 respondents who were all given the opportunity to answer the charges against them, and the complexities of the issues that required careful study and consideration of voluminous documents submitted in the course of the investigation – the Court finds that the length of time spent by both the Department of Justice and the Office of the Ombudsman before issuing the resolutions that culminated in the filing of the cases in court is reasonable and acceptable,” anang korte.

Binanggit din ng Sandiganbayan na hindi nabahiran ng “vexatious, capricious and oppressive delays” ang imbestigasyon.

“Rather, the length of time spent in the investigation indicates that a careful examination and review of the evidence and documents were thoroughly undertaken before the cases were filed in court,” anito.

Dating Department of Health (DOH) secretary, kinasuhan si Garin sa umano’y ilegal na procurement ng P3.5 bilyong halaga ng Dengvaxia, isang anti-dengue vaccine, noong 2015.

Sa kasalukuyan ay wala pang tugon si Garin sa nasabing ulat.

Sa pahayag niya nang makapagpiyansa noong Nobyembre 2023, iginiit ni Garin, nanungkulan bilang DOH chief sa administrasyon ni dating Pangulong Benigno Aquino III, na inosente siya.

“Posting bail is part of the agonizing process to prove our innocence. It is a crucial step in ensuring a fair trial and safeguarding one’s rights,” pahayag niya.

“We hope that this first step into clearing our name can be dealt with timely so that scientists and doctors can perform our regular tasks,” patuloy ni Garin.

Sa charge sheet na may petsang October 24, 2023, inakusahan ng government prosecutors si Garin at kanyang co-accused na “willfully, unlawfully and feloniously” na pumayag sa paglalabas ng P3.5 bilyong public funds upang dagdagan ang budget ng Expanded Program for Immunization (EPI) subalit ginamit ang nasabing pondo para sa Dengvaxia purchase, na hindi bahagi ng EPI.

Ayon pa sa Ombudsman, wala ang Dengvaxia vaccines sa listahan ng Volume 1 ng Philippine National Drug Formulary at hindi nakakuha ng exemption na makasama sa Philippine National Drug Formulary sa paglabag sa Executive Order No. 49, series of 1993, at kaugnay na administrative orders at issuances.
