Income tax na singil sa mga water bill, ibinawal ng SC

MANILA, Philippines – Hindi maaaring maningil ang water concessionaires na Maynilad at Manila Water ng income tax sa mga consumer nito para kumita.

Nakasaad sa mahigit 100-pahinang desisyon ng Supreme Court na ang Maynilad at Manila Water ay mga public utilities na ang pinaglilingkuran ay ang publiko.

“Considering that Manila Water and Maynilad operate the waterworks and sewerage system, they are public utilities which are expressly prohibited from passing on to consumers their corporate income taxes as operating expenses,” nakasaad sa desisyon ng SC.

Sinabi ng SC na sa sandaling pumayag sila na ipasan ito sa mga consumer, malaking bilang sa mga ito ang magbabayad sa isang bayaring wala naman silang pakinabang.

Iginiit rin ng Korte Suprema na hindi ito maaaring ituring na business tax para ipasa sa mga consumer.

Samantala, sinabi ng SC na hindi na mababawi ng mga consumer ang nasingil na income tax sa water bill sa mga nakalipas na taon.

“No such administrative recourse was made here since the parties involved this Court’s jurisdiction on the first instance without contesting the rates before the National Water and Resources Board (NWRB). This Court, therefore, has no jurisdiction to order an adjustment of the rates changed after the past rate rebasing exercises,” dagdag ng korte. Teresa Tavares
