MANILA, Philippines- Pina-iinhibit ng Department of Justice si Muntinlupa RTC Br. 204 Judge Abraham Joseph Alcantara sa pagdinig sa ikatlo at huling drug case na kinakaharap ni dating Senador Leila de Lima.
Nai-raffle sa sala ni Alcantara ang ikatlong drug case ni De Lima matapos mag-inhibit si Judge Romeo Buenaventura.
Magugunita na si Alcantara rin ang duminig sa ikalawang drug case ng dating senador at inabswelto ito dahil sa pag-urong sa testimonya ng mga testigo.
Sa inihain na apat na pahinang Motion for Voluntary inhibition, iginiit ng prosecution panel na nararapat magbitiw sa paghawak ng naturang kaso si Alcantara upang maalis ang anumang pagdududa sa magiging desisyon nito lalo pa at nananatiling kwestiyonable sa DOJ ang naging desisyon nito sa ikalawang drug case ni De Lima.
“We reiterated that when a judge exhibits actions that give rise, fairly or unfairly, to perceptions of bias, such faith and confidence are eroded, and he has no choice but to inhibit himself voluntarily. A judge may not be legally prohibited from sitting in a litigation, but when circumstances appear that will induce doubt on his honest actuation and probity in favor of either party, or incite such state of mind, he should conduct a careful self-examination. He should exercise his discretion in a way that the people’s faith in the courts of justice is not impaired. The better course for the judge is to disqualify himself,” nakasaad sa mosyon.
Iginiit ng panel of prosecutors na kailangang matiyak ang patas na paggalaw ng hustisya.
