Maghahain ng motion for reconsideration (MR) ang Commission on Elections (Comelec) matapos ipag-utos ng Court of Tax Appeals (CTA) na magbayad ang komisyon ng P1.1 bilyong buwis na ipinagkait mula sa mga empleyado noong 2015.
Sinabi ni Comelec spokesperson Rex Laudiangco na ang MR ay ihahain base sa CTA rules of procedure.
“Given the recent decision on the subject tax case, the Comelec will be seasonably filing a motion for reconsideration with the Honorable Court of Tax Appeals Division iterating our affirmative defenses and justifications to ensure sufficient emphasis and consideration thereof,” sabi ni Laudiangco sa Viber message.
Gayunpaman, hindi pa nakakatanggap ang Comelec ng kopya ng CTA’s decision . Ayon kay Laudiangco maghahain sila ng MR kapag opisyal na nilang natanggap ang kopya .
Sinabi ni Laudiangco na dapat gawin ng Comelec ang aksyon na ito matapos pagtibayin ng CTA ang kahilingan ng Bureau of Internal Revenue (BIR) sa pananagutan ng poll body.
“A petition for review, as well as another motion for reconsideration, may be filed with the Court of Tax Appeals en banc after the initial MR with the Division,” sabi ni Laudiangco.
“In all cases of this nature, a petition for review on certiorari may be filed with the Supreme Court, as may be appropriate and necessary, and should the situation further warrants.” dagdag pa ni Laudiangco.
Ang CTA ay naglabas ng 22 pahinang desisyon na pumapabor sa BIR assessment sa mahigit isang bilyong pisong pananagutan ng Comelec para sa deficiency withholding taxes. Jocelyn Tabangcura-Domenden
