MANILA, Philippines- Naglabas si Pangulong Ferdinand R. Marcos Jr. ng Executive Order (EO) No. 32, naglalayong padaliin ang permitting process para sa konstruksyon ng telecommunications at Internet infrastructure sa bansa.
Binigyang-diin sa EO ang kahalagahan na i-institutionalize ang itinakdang streamlined guidelines para sa pagpapalabas ng permit, lisensiya, at sertipiko para sa konstruksyon ng telecommunications at Internet infrastructures para masiguro ang tuloy-tuloy na development ng digital infrastructure ng bansa.
Sa pagpapalabas ng EO, sinabi ni Pangulong Marcos na sakop ng kautusan ang lahat ng national government agencies (NGAs) at instrumentalities, kabilang na ang government-owned or –controlled corporations, at maging ang local government units (LGUs) na kabilang sa pagpapalabas ng permit, lisensiya, clearances, sertipikasyon at autorisasyon.
“Among those covered include construction, installation, repair, operation and maintenance of Shared Passive Telecommunications Tower Infrastructure; and, erection of poles, installation of aerial and underground cables and facilities, underground fiber ducts, ground terminals and other transmission telecommunications and Internet infrastructure and facilities,” ayon sa Malakanyang.
“No other national or local permit or clearance shall be required in the construction, installation, repair, operation, and maintenance of telecommunications and Internet infrastructure,” ang nakasaad sa EO kaugnay ng streamlined requirements sa infrastructure construction.
Ang mga exempted naman ay building permits na ipalalabas ng Office of the Building Official; Height Clearance Permit mula sa Civil Aviation Authority of the Philippines (CAAP), homeowners associations at iba pang community clearances, clearances mula sa ibang ahensiya ng pamahalaan at iba pang na nakamandato sa Konstitusyon at umiiral na batas.
Ang kautusan ng Pangulo ay may mandato rin sa lahat ng lungsod at munisipalidad na magtatag o magtayo ng one-stop shop para sa construction permits, na magbibigay ng frontline services sa mga aplikante na humihingi ng building permits at iba pang kaugnay na sertipiko.
“Subject to existing laws, rules and regulations, all covered government agencies and LGUs are enjoined to implement zero backlog policy in all applications for permits and clearances covered by EO 32, which also required them to comply with the annual submission of list of pending applications and compliance to the Anti-Red Tape Authority (ARTA),” ayon sa Malakanyang.
Inorganisa rin ng EO ang isang Technical Working Group (TWG) ukol sa Telecommunications and Internet Infrastructure bilang isang oversight body para tiyakin ang epektibong implementasyon ng kautusan.
Ang TWG, pamumunuan ng Department of Information and Communications Technology (DICT), ay may mandato na lumikha ng implementing rules and regulations ng EO sa loob ng 60 araw mula sa effectivity o pagiging epektibo ng kautusan. Kris Jose
