MANILA, Philippines- Ibinasura ng Sandiganbayan ang petisyon ng pamilya Marcos na marekober ang ilang asset, kabilang ang ilang frozen accounts.
Sa 40-page decision na may petsang Jan. 25, sinabi ng anti-graft court’s Fourth Division na ibinasura nito ang omnibus motion para sa writ of execution — na inihain ni dating First Lady Imelda Marcos at kanyang anak na si Irene Marcos-Araneta — dahil sa lack of merit.
Kabilang sa properties sa kanilang plea ang mga na-forfeit sa compromise agreements, maging mga nasamsam ng Presidential Commission on Good Government (PCGG). Kabilang din sa listahan ang ilang korporasyon at real estate assets.
“[T]he Court dismissed the third amended complaint with respect to the properties that ‘have already been recovered by the government or transferred to third persons not involved herein,’ or those which have been the subject of Court decisions and compromise agreements as the same were barred by res judicata under its second concept, i.e., conclusiveness of judgment and mootness. Thus, the Court can no longer rule on the said properties,” saad sa ruling ng Sandiganbayan, na isinulat ni Associate Justice Michael Frederick Musngi.
Sa kanilang petisyon, nais nina Marcos at Araneta na ideklarang hindi ill-gotten ang mga pagmamay-ari at dapat na ibalik sa mga nagmamay-ari nito. Anila pa, walang “valid contract” sa compromise agreements sa PCGG.
Binigyang-diin din ng Marcoses na lumabas lamang ang hatol sa kanilang kaso matapos ang ilang dekada.
“As a consequence, the defendants have suffered greatly, mentally and emotionally, and the dissipation of seized properties causing unjust and unreasonable deprivation of their proprietary rights,” anila.
Subalit, ayon sa Sandiganbayan, ang argumento ay “not a good reason” dahil sa ilang salik na nakaambag sa period ng proceedings.
“Such return and/or recovery should be the subject of an independent action to recover ownership, control, and/or possession of any such property/ies to be determined in a separate proceeding filed before a court of competent jurisdiction in accordance with law,” giit ng korte.
Kinahaharap ng pamilya Marcos ang ilang kaso kabilang ang umano’y ill-gotten wealth — kung saan ibinasura ng tribunal ang ilan sa mga ito. RNT/SA
