MANILA, Philippines – Inilarawan ni Senate Minority Leader Aquilino “Koko” Pimentel III nitong Miyerkules, Oktubre 18 ang suspensyon ng implementasyon ng Maharlika Investment Fund (MIF) bilang isang “very good development.”
Ani Pimentel, na nauna nang sumubok sa legalidad ng batas na naglilikha sa MIF sa Korte Suprema, ang MIF ay “defective.”
“Very good development. The law has a lot of defects. The concept has not been fully studied from the very start. Hence we should not wonder why apparently the law is not ready for implementation,” pahayag ni Pimentel.
“Good that the Marcos administration appears to listen to reason.”
Sa October 12 memorandum na inilabas ni Executive Secretary Lucas Bersamin, sa kapangyarihan ni Pangulong Ferdinand Marcos Jr., ipinag-utos ang suspensyon sa pagpapatupad ng implementing rules and regulations (IRR) ng MIF law “pending further study.”
Ang memorandum ay ipinahatid kina Bureau of Treasury officer-in-charge Sharon Almanza, Land Bank of the Philippines president and CEO Lynette Ortiz, at Development Bank of the Philippines president at CEO Michael de Jesus.
Noong Hulyo ay pinirmahan ni Marcos bilang isang batas ang Republic Act No. 11954 o ang Maharlika Investment Fund Act of 2023 na layong gumamit ng state assets para sa investment ventures at kumita ng karagdagang pondo para sa publiko.
Lilikhain ng batas ang Maharlika Investment Corp. (MIC), isang government-owned company na mangangasiwa sa MIF o poll of funds na kinuha mula sa state-run financial institutions at gagamitin pang-invest sa high-impact projects, real estate, maging sa financial instruments.
Noong Setyembre naman, hiniling nina Pimentel, kasama sina Bayan Muna chairman Neri Colmenares at dating Bayan Muna Representatives Isagani Zarate at Ferdinand Gaite, sa Korte Suprema na ideklara ang MIF Law na “unconstitutional.”
Sa kanilang 56-pahinang petition for certiorari and prohibition, iginiit ng petitioners na ang MIF Law ay unconstitutional dahil sa paglabag nito sa economic viability, paglabag sa Bangko Sentral ng Pilipinas Independence, at paglabag sa three-reading rule sa legislative process. RNT/JGC
