MANILA, Philippines – Iimbitahan si Vice President Sara Duterte na dumalo sa impeachment proceeding ngunit nasa kanya ang desisyon kung dadalo o hindi, ayon kay House Committee on Justice Chairperson Gerville Luistro.
“Let us understand na ‘yung presence during the hearing proper is part of her due process. In other words, the prerogative belongs to her. Whether she wants to come or not to come, that is actually her option,” ani Luistro.
Ang susunod na pagdinig ng komite ay pagdetermina kung sufficient in grounds ang impeachment complaint kung saan ihaharap na ng mga complainant ang mga ebidensya. Kapag pumasa sa grounds, ang kasunod ay pagdetermina kung may probable cause.
Sinabi ni Luistro na kailangan ng 28 boto mula sa 55 miyembro ng komite para umusad ang reklamo laban kay VP Duterte.
“The panel is composed of 55 members, including ex-officio members, meaning at least 28 votes are needed to secure the required majority,” ani Luistro.
Samantala, kasama rin sa sisilipin ng panel ang bank records ni Duterte. Sinabi ni Luistro na sa impeachment proceedings ay exception ang bank secrecy law.
“As a general rule, the bank secrecy law protects the confidentiality of all bank records. However, there is an exception — the impeachment proceedings or impeachment cases,” pahayag ni Luistro, kung saan magpapalabas ang komite ng subpoena duces tecum na mag-oobliga sa mga bangko na isumite ang mga bank documents.
Nilinaw ni Luistro na ang mga hakbang na ito ay kailangan pang pagbotohan ng komite.
Ang pagpapatuloy ng impeachment proceeding ay sa ikalawang linggo na ng Abril o pagkatapos ng Holy Week dahil hihintayin pa ng komite ang mga sagot ng magkabilang panig gayundin ang mga kalakip na ebidensya sa kaso. Gail Mendoza
