Shari’ah Bar passers hinikayat ng SC chief na kumuha ng PH Bar exam

MANILA, Philippines – Hinikayat ni Supreme Court Chief Justice Alexander Gesmundo ang mga abugado na ikonsiderang kumuha ng Shari’ah Bar Exams upang mapabuti ang kanilang partisipasyon sa Shari’ah courts.

Sa ginanap na Second Shari’ah Summit: A JudicialCareer Enhancement Program for the Shari’ah Courts, hinimok din ni Gesmundo ang mga Shari’ah counselors na kumuha ng Philippine Bar Exam upang maging ganap na abugado.

Taon 1993 ng ideklara ng SC na ang mga nakapasa sa Shari’ah Bar exams ay ituturing na special members ng Philippine Bar at hindi mga full-fledged members kahit nagtapos ng Bachelor of Laws degree.

Maari lamang nila ipractice ang kanilang propesyon sa Shari’ah courts.

Sa Pilipinas ang Shari’ah court system ay nasa pangangasiwa ng Supreme Court at nagreresolba ng mga kasong may kaugnayan sa Muslim Personal Law.

Layunin ng idinaos na summit na mabigyan ang mga hukom ng sapat na kaalaman at kakayanan sa Shari’ah law.

Binigyan-diin ng punong mahistrado ang plano ng SC na repasuhin ang Shari’ah Justice system at ang Shari’ah Legal Education System.

“This is in recognition of our constitutional duty, if not moral obligation, to promote an inclusive environment free of biases against all genders and social sectors, against any religious belief and even political persuasion.”

Sinang-ayunan ito ni Senior Associate Justice Marvic M.V.F. Leonen, Chairperson ng Supreme Court Committee on Access to Justice/Underserved Areas and of the Committee on Human Rights. Ayon kay Leonen, nasa proseso na ang Korte ng pagbalangkas ng mga panukalang amienda sa B.P. 129 o ang Judiciary Reorganization Act of 1980 dahil walang binabanggit dito ang Shari’ah courts.

“If we are to deliver justice, our laws and rules of procedure must be inclusive. It is high time for us to start thinking about amending B.P. 129 to include Shari’ah courts in the integrated judiciary system. It is time we review Shari’ah’s codified personal laws and the Rules of Procedure of its courts,” ani Leonen.
