MANILA, Philippines — Ang desisyon ng Korte Suprema (SC) sa impeachment case laban kay Bise Presidente Sara Duterte ay lilikha ng “merly political crisis” at hindi constitutional, sinabi ng isang election lawyer nitong Linggo.
Ayon ito sa abogadong si Romulo Macalintal ilang araw matapos pagpasiyahan ng Supreme Court (SC) na ang impeachment case na inihain ng House of Representatives laban kay Vice President Sara Duterte ay labag sa konstitusyon at pinagbabawalan ng “one-year rule.”
Gayunpaman, sinabi ni SC spokesperson Camille Ting na hindi inaabswelto ng desisyon na ito si Duterte sa mga paratang sa kaniya.
Ayon kay Macalintal, dapat igalang ang desisyon ng SC “more so if we reconsider the fact that the issues and the parties are more political than legal.”
Sinabi ni Macalintal na lalabas ang political crisis sa oras na maghain ng motion for reconsideration ang House of Representatives sa SC.
“While the decision of the SC is “immediately executory” the same is not yet final, hence, the HR and/or the Senate may still file a motion for reconsideration (MR) before the SC. And while this MR is not yet decided with finality, the Senate may proceed hearing Duterte’s impeachment case,” saad ni Macalintal.
Sinabi niya na ang mga senador na nakaupo sa Impeachment Court, ang magdedesisyon sa impeachment case ni Duterte, at hindi ang SC.
Sinabi ng House spokesperson na si Princess Abante nitong Linggo na maghahain ang lower chamber ng MR sa SC, na binanggit ang “factual errors” at mga natuklasan na sumasalungat sa unang opisyal na mga rekord.
Sinabi rin ni Abante na ang SC ay nagpataw ng bagong requirements na hindi makikita sa alinman sa Konstitusyon o mga panuntunan sa Kamara, na binibigyang-diin na ginawa ng Korte ang Articles of Impeachment bilang “null and void” para sa mga bagong tuntunin na angkop sa proseso para kay Duterte, bilang respondent.
“Based on the Court, any complaint that is signed and verified by 1/3 of the members need to be read by every signatory and will be referred to the plenary to vote. The respondent should also be given a copy and opportunity to answer the complaint before being transmitted to the Senate. But there are no requirements like these on the Constitution or rules of the House,” ayon kay Abante sa hiwalay na pahayag.
Binanggit naman ni Macalintal na ang legal team ni Duterte, tiyak, ay maghahain ng mosyon para i-dismiss ang kaso batay sa desisyon ng SC na hindi kailanman nakuha ng Senado ang jurisdiction sa kaso dahil sa paglabag sa one-year ban rule at sa paglabag sa karapatan ni Duterte sa due process nang hindi siya nabigyan ng pagkakataong ipaliwanag ang kanyang panig bago ihatid sa Senado ang Articles of Impeachment.
“The motion to dismiss might be opposed by the prosecutors. Thereafter, the Impeachment Court may hear the arguments of the parties, either by oral arguments or by pleadings,” ayon kay Macalintal.
Sinabi din ni Macalintal na ang mga senator-judges ay humihingi ng paglilinaw sa mga abogado ng mga partido bago bumoto kung tatanggihan o pagbibigyan ang mosyon para i-dismiss “will then unmask the individual position or partisan character of each and every Senator on this highly politicized issue.” RNT/MND
