MANILA, Philippines – Sinuspinde ng Office of the Ombudsman si Nueva Ecija Governor Aurelio Umali sa loob ng isang taon nang walang sweldo.
Ang suspensyon ay nag-ugat mula sa reklamo laban kay Umali at iba pang opisyal ng pamahalaan na nag-isyu umano ng quarry permit nang walang Environmental Compliance Certificate (ECC) mula sa Department of Environment and Natural Resources (DENR).
Sa inilabas na hatol ng Ombudsman, si Umali ay napatunayang lumabag sa Section 25(2) ng Republic Act 6770, OMB Act of 1989, at Section 10(b), Rule III ng Administrative Order No. 7 ng Rules of Procedure ng graft court, kaya sinuspinde ito ng isang taon na walang suweldo.
Ang kaso ay nag-ugat sa isinampang reklamo ni Roberto M. Duldulao sa Ombudsman kung saan ibinunyag nito ang pag-‘hokus-pokus’ ni Umali sa 205 Commercial Sand and Gravel Permits (CSGPs) na ibinigay sa mga hindi kuwalipikadong haulers at walang ECC mula sa Mines and Geosciences Bureau ng DENR.
“There is a basis to hold Aurelio Umali administratively liable. He was remiss in his duty to ensure the enforcement and compliance with all laws, rules and regulations within his jurisdiction,” ayon sa desisyon ng Ombudsman.
Ang hatol kay Umali ay base sa rekomendasyon na isinumite ni Graft Investigation and Prosecution Officer III Leilani P. Tagulao-Marquez sa opisina ni Assistant Ombudsman Pilarita T. Lapitan at inaprubahan naman ni Ombudsman Samuel R. Martires sa pamamagitan ni Deputy Ombudsman Dante F. Vargas.
“While Gov. Aurelio Umali’s act of issuing the CSGPs from 2014 to 2016 was neither motivated by a premeditated, obstinate, or intentional purpose, his acts still sufficiently constitute the offenses of Conduct Prejudicial to the Best Interest of the Service and Simple Misconduct,” giit pa sa desisyon.
