MANILA, Philippines – Upang hindi na magkaroon ng delay sa impeachment proceeding, nagdesisyon ang ikatlo at ikaapat na complainant sa impeachment case na hindi na maghain ng “reply” sa katwirang “non-answer” naman ang isinumiteng sagot ni Vice President Sara Duterte.
Sa isinumiteng Manifestation of Waiver to File a Reply sa House Committee on Justice ni Atty. Amando Virgil D. Ligutan, legal counsel ng complainants sa pangunguna ni Reverend Father Joel T. Saballa, na ang 15-pahinang Consolidated Verified Answer ni Duterte ay malinaw na hindi “responsive pleading”.
“Considering that respondent’s 15-page Consolidated Verified Answer conspicuously failed to specifically deny each and every material allegation in the 98-page impeachment complaint, complainants deem it unnecessary to file a reply thereto,” pahayag ni Ligutan.
Sinabi ni Ligutan na sa kabila ng seryosong mga akusasyon kay Duterte ay pinili nitong ‘di sumagot.
“Despite the gravity of the accusations against her, and the unmistakable public character of the funds she is charged with misappropriating, respondent ultimately said nothing to defend herself.
Given these circumstances, the complainants saw no reason to prolong the exchange of pleadings,” paliwanag ni Ligutan.
Ganito rin ang posisyon ng ikaapat na complainant na si Atty. Nathaniel Cabrera. Sa inihaing dalawang pahinang manifestation, sinabi nito na nabigo si Duterte na itanggi ang anuman sa mga inaakusa sa kanya.
“The Answer does not squarely traverse the ultimate facts alleged and effectively amounts to a non-answer,” paliwanag ni Cabrera.
Ang ikatlong impeachment complaint ay nakasentro sa kontrobersiyal na paggasta ng ₱125 million confidential fund sa loob ng 11 araw, habang ang ikaapat na reklamo ay ilegal na paggamit ng confidential funds, unexplained wealth, at maling deklarasyon sa Statements of Assets, Liabilities and Net Worth.
