MANILA, Philippines – Magpapatuloy ang pagdinig ng House Committee on Justice sa mga reklamong impeachment laban kay Sara Duterte ngayong Abril 29, sa kabila ng mga hakbang upang ito’y mapatigil, ayon kay Gerville Luistro.
Ito ay matapos magsampa ng reklamo ang asawa ng Bise Presidente na si Manases “Mans” Carpio sa Quezon City Prosecutor’s Office laban kay Luistro at iba pang miyembro ng komite, gayundin sa mga opisyal ng Anti-Money Laundering Council at Bangko Sentral ng Pilipinas. Kaugnay ito ng umano’y paglabag sa Bank Secrecy Law, Data Privacy Act, at Anti-Money Laundering Act matapos isapubliko ang bank transactions sa pagdinig noong Abril 22.
“It depends on the justice members if they will consider this [Carpio court filing] in their determination of probable cause. But as far as our proceeding is concerned, we will just proceed with our hearing and conclude it in the determination of probable cause,” ani Luistro.
Sa naturang pagdinig, iniulat ng AMLC ang kabuuang P6.7 bilyong bank transactions na naka-rehistro sa pangalan nina Duterte at Carpio, na tinukoy bilang covered at suspicious. Sa halagang ito, P3.7 bilyon ang iniuugnay sa Bise Presidente at P2.998 bilyon kay Carpio. Hindi umano ito nakasaad sa SALN ng Bise Presidente mula 2019 hanggang 2024.
“Why is this figure not indicated in her SALN entries? This is hard to explain. Where did such huge amount of money came out? And where did it go?,” ayon kay Terry Ridon.
“Wala sa SALN ‘yan (It is not reflected in her Statement of Assets, Liabilities and Net Worth),” sabi naman ni Joel Chua.
Ipinaliwanag naman ng abogado ng Bise Presidente na si Michael Poa na walang idineklarang cash on hand si Duterte mula 2019 dahil ito ay “lumped” sa “others” category sa kanyang SALN.
Ayon kay Luistro, maaaring makatulong ang income tax returns (ITRs) upang ipaliwanag ang P88 milyong net worth ng Bise Presidente noong 2024. Gayunman, hinarang ng Bureau of Internal Revenue ang pagbubukas ng kahon na naglalaman ng mga ITR. Sinabi ni Charlito Mendoza na maaari lamang itong suriin sa executive session at kung ito ay in aid of legislation.
“SALN is supposed to disclose the personal income of the spouses. And so, the ITRs can justify the P88 million [declaration of net worth by the Vice President in 2024]. It could be of help to the prosecution or the defense team, but we cannot tell now because we haven’t seen the contents of that box,” ani Luistro.
Ayon sa batas, ang covered transactions ay yaong lampas P500,000 sa loob ng isang araw ng pagbabangko, habang ang suspicious transactions ay yaong walang malinaw na legal o ekonomikong batayan, hindi tugma sa kakayahang pinansyal ng kliyente, inistruktura upang makaiwas sa reporting requirements, lumilihis sa karaniwang transaksyon, o may kaugnayan sa ilegal na aktibidad.
Bukod sa reklamong inihain ni Carpio, may tatlo ring petisyon na nais ihinto ang impeachment proceedings na nakabinbin sa Supreme Court of the Philippines. RNT
