MANILA, Philippines – Nagbabala ang International Criminal Court (ICC) Trial Chamber III sa mga abogado na sangkot sa kaso ni dating Pangulong Rodrigo Duterte laban sa pagbibigay ng komento sa media kaugnay ng mga pagdinig sa kaso.
Sa ikalawang status conference nitong Martes, sinabi ni Presiding Judge Joanna Korner na malaki ang atensyong nakukuha ng kaso sa media at social media sa Pilipinas, kabilang ang pagkalat ng maling impormasyon.
“In the light of this previous history, this Trial Chamber feels it incumbent to repeat the reminder or warning to all counsel in the case, for the reasons that I have already expressed as to the importance of this trial,” ani Korner.
“We see no reason why counsel should feel it necessary to make any comment to the media. The appropriate forum for counsel to raise matters is in the courtroom,” dagdag niya.
“Trials are not conducted by the court of public opinion but by this court during the course of the proceedings.”
Nanawagan din si Korner sa media na maging tumpak at patas sa pag-uulat at iwasan ang mga haka-haka.
Tinukoy ng hukom ang mga panayam noon ni Nicholas Kaufman, dating abogado ni Duterte, at sinabing ang ilan sa mga naging pahayag nito hinggil sa mga desisyon ng ICC ay “wholly inappropriate.”
“Some of those comments were his personal view of legal decisions made by the court as a whole and were, on any showing, wholly inappropriate, the more so when made by counsel in the case,” aniya.
Ipinahayag din ni Korner ang pagkabigla na walang partikular na gabay hinggil sa pakikitungo sa media ang Defense Code of Conduct at sinabi na dapat itong maisaayos sa lalong madaling panahon.
Nagbitiw bilang abogado ni Duterte si Kaufman noong Mayo at pinalitan ni lawyer Peter Haynes.
Nahaharap si Duterte sa kasong crimes against humanity kaugnay ng mga umano’y pagpatay sa panahon ng kanyang panunungkulan bilang pangulo at alkalde ng Davao City. Nakatakdang magsimula ang paglilitis sa Nobyembre 30, 2026. Dave Baluyot
