MANILA, Philippines — Sinabi ni Sen. Francis “Chiz” Escudero, presiding officer ng Senado na tumatayong impeachment court, na kailangan ng hindi bababa sa 16 affirmative votes mula sa mga senator-judge upang ma-convict si Vice President Sara Duterte sa kaniyang impeachment trial.
Ginawa ni Escudero ang pahayag matapos niyang tanggapin ang posisyon bilang presiding officer, kasabay ng pagbibigay-diin na nakasaad sa Konstitusyon na walang maaaring ma-convict nang walang pagsang-ayon ng two-thirds ng lahat ng miyembro ng Senado.
“With 24 members of the Senate, a literal interpretation of this means that conviction requires the affirmative vote of at least 16 senator-judges,” pahayag ni Escudero.
Binanggit ni Escudero ang 2000 case na Bayan v. Zamora, na may kaugnayan sa pagsunod ng Senado sa two-thirds vote na kailangan para sumang-ayon sa isang treaty. Ipinaalala niya na noong panahong iyon ay 23 lamang ang incumbent senators matapos mahalal na bise presidente si dating senador Gloria Macapagal-Arroyo.
“The Court held: The charter provides that the Senate shall be composed of 24 senators; without a tinge of doubt, two-thirds of the figure or not less than 16 members is an unquestionable compliance with the requisite number of votes mentioned in Section 21 of Article 7,” ani Escudero.
“It behooves therefore all of us to observe the same fidelity with the Constitution in this trial, which affects not only the mere ratification of a treaty, but more so affects the substantial rights of the respondent, as well as the sovereign will of the people as expressed in the overwhelming mandate given to her,” dagdag niya.
Ayon kay Escudero, kailangang sundin ang umiiral na batas, sang-ayon man dito o hindi ang mga senator-judge.
“This is the prevailing law today. And whether we agree with it or not, we must abide by it,” aniya.
Ang pahayag ni Escudero ay kasunod ng pag-aresto kay Sen. Rodante Marcoleta ilang oras bago nito dahil sa kasong plunder. Ilang linggo na rin ang nakalipas nang maaresto si Sen. Jinggoy Estrada sa kasong plunder at mula noon ay sinuspinde na ng 90 araw. Si Sen. Ronald “Bato” Dela Rosa naman, na may warrant of arrest mula sa International Criminal Court dahil sa crimes against humanity, ay pinaniniwalaang nagtatago.
Pormal na nahalal si Escudero nitong Lunes ng hapon bilang presiding officer ng impeachment trial ni Duterte. Dati na rin siyang namuno sa impeachment court noong 2025, nang siya pa ang Senate president, kung saan binatikos siya sa pagtatakda ng impeachment trial sa panahong itinuturing ng marami na hindi akma sa terminong “forthwith.”
Pinaalalahanan din ni Escudero ang kaniyang mga kapwa senador na magpatupad ng patas na hustisya alinsunod sa Konstitusyon at mga batas.
“As presiding officer, I shall do my part to uphold the fairness and integrity of this process, and shall see it through to its proper conclusion,” ani Escudero.
Binigyang-diin din ni Escudero na hindi niya hiniling o hinangad na mahalal sa posisyon. RNT
