MANILA, Philippines – Ibinasura ng Sandiganbayan ang mosyon ng mga prosecutor na alisin si dating Public Works secretary Manuel Bonoan sa kasong graft na kinasasangkutan din ni Senator Jinggoy Estrada kaugnay ng umano’y kickbacks mula sa P855-milyong flood control project sa Bulacan.
Sa 12-pahinang resolusyon na may petsang Agosto 3, sinabi ng Second Division ng anti-graft court na makapipinsala sa karapatan ni Estrada ang pag-aalis kay Bonoan sa kaso dahil na-arraign na ang senador. Naantala naman ang arraignment ni Bonoan dahil sa kondisyon ng kaniyang kalusugan.
Nag-ugat ang kaso sa umano’y P213 milyong kickbacks mula sa naturang proyekto.
“(S)ince accused Estrada has already been arraigned and the proposed amendment by the prosecution being substantial rather than formal in nature, the original information cannot be amended without prejudicing the rights of the accused,” ayon sa korte.
“At this stage of the proceedings, the Court finds that the exclusion of accused Bonoan would unduly restrict the defenses available to accused Estrada. Accused Bonoan’s participation as a co-accused may bear upon the presentation of evidence, the determination of the parties’ respective roles and the full ventilation of the issues surrounding the alleged offense,” dagdag nito.
Nilinaw ng Sandiganbayan na maaari pa ring hilingin ng prosekusyon sa tamang yugto ng paglilitis na alisin si Bonoan bilang akusado at gawing state witness, basta matugunan ang mga rekisito sa ilalim ng mga patakaran.
“This, however, does not prejudge accused Bonoan’s potential value as a possible witness for the prosecution, nor does it pass upon the credibility or probative weight of any testimony he may give later on,” sinabi ng korte.
“The prosecution is not precluded from subsequently seeking accused Bonoan’s discharge as a state witness as it remains at liberty to seek his discharge at the appropriate stage of the proceedings, provided that the requisites under the rules are met,” dagdag nito.
Inakusahan sina Estrada at Bonoan na tiniyak umano ang pagkakasama ng mga proyekto sa 2025 national budget at ang paggawad ng mga kontrata sa mga napiling contractor. Inakusahan din silang nangolekta ng mga commitment at nagbigay ng hindi nararapat na benepisyo, bentahe o pabor sa mga contractor. Santi Celario
