Abogado ni Sara, sinopla ng COA auditor sa pagbili ng gamot, pagkain gamit secret funds

MANILA, Philippines – Nakatikim ng isang matinding pagsopla ang defense team ni Vice President Sara Duterte mula sa auditor ng Commission on Audit (COA) na sumuri sa P73 milyong confidential funds na karaming ipinambili ng pagkain at gamot.

Sa pagpapatuloy ng impeachment trial ni Duterte hinggil sa paglulustay ng pondo ng bayan, sinabi COA auditor Xylene Mae del Campo na hindi sakop ng confidentiality ng operasyon ng Office of the Vice President ang pagbili ng gamot, pagkain at iba pang suppliles bagkus confidential ang “purpose” ng pagbili ng produkto.

Naunang tinanong ni defense counsel Kristine Ferrer si del Campo na kung dapat ilantad nng OVP ang pangalan at address ng mga kampanya na nagparenta sa ilang safe house nito para sa confidential operations, kahit malalagay sa panganib ang kanilang buhay.

Sa puntong ito, biglang bumalikwas si del Campo kay Ferrer kabilang si Presiding Officer and Senator-judge Francis Escudero na kailangan nila ang official receipts or sales invoice na tumutukoy sa pagbili ng supplies, hindi ang ginamit na pondo para pag-upa sa safe house.

Kaya dahi dito, itinanong ni Escudero kay Campo kung paniniwala nito bilang auditor na hindi maaaring ikonsiderang confidential ang pinagbilhan ng supplies tulad ng gamot at pagkain – na siyang tinugon ng tauhan ng COA na “yes”.

“So sa pananaw mo, hindi kailangang maging confidential ‘yung binilhan ng supplies?” ayon kay Escudero.

“(Yes) kasi po ang confidential, ‘di ba po ‘pag bumibili tayo ng supplies, ng food, ng medicine, ang standard procedure po ‘yong merong resibo na matatanggap from the establishment kung saan po natin binili itong mga supplies, food and medicines,” sagot ni del Campo.

“The providers of these supplies are not confidential. What is confidential is the purpose of why these expenses were made,” giit niya.

Pagkatapos nito, tinanong naman ni Ferrer si del campo kung alin sa mga detalye na kinasasangkutan ng ilang kampanya na nagbibigay ng supplies na maaaring tanggalin sa confidentiality purposes.

Tinutulan ito ni prosecution counsel Lorna Kapunan dahil naitanong na at nasagot ang isyu.

“Counsel, asked and answered because she said that when it pertains to the purchase of supplies, food, medicines, chairs, if at all, computers, the name of the entity where they purchased it is not confidential,” ayon kay Escudero.

“Pero kung saan ginamit ‘yon, kung sino ang pinagbigyan, sino ang pinakain, saan pinakain, ‘yon ‘yong confidential. Tama ba Xylene?” tanong ni Escudero na kinumpirma ni del Campo affirmed.

“So ‘yung invoice o resibo ng pagkain, medical supplies, supplies, kailangan may resibo. ‘Yun ang interpretasyon mo?” tanong ni Escudero.

“Opo, para ma-ascertain namin na talagang ginamit ‘yon for purchases of food supplies and medicines po […] para mapatunayan na pinambili po talaga ito ng supplies,” tugon ni del Campo.

Sinusuri ng impeachment court ang Article 1 ng Articles of Impeachment hinggil sa alegasyon na nilustay ni Duterte ang confidential funds na ginawa ng Office of the Vice President at Department of Education (DepEd).

Noong nakaraang Agosto 3 sa testimonya ni state auditor Roderick Wamil — pinalitan ni del Campo sa COA-Intelligence and Confidential Funds Audit Office (ICFAO) — na ginamit ang  P40 million ng CF ni OVP ay ipinambili ng gamot na ginamit naman bilang rewards sa confidential informants.

Pero, binanggit din ni Wamil na hindi ito pinapayagan ng Joint Circular No. 2015-01, na nagtatakda ng alituntunin kung paano gagamitin ang CFs.

Sa ilalim ng  Item 4.8 of the Joint Circular, Maaaaring gamitin ang CFs sa mga sumusunod na kadahilanan:

1.     Purchase of information necessary for the formulation and implementation of programs, activities and projects relevant to the national security and peace and order

2.     Rental of transport vehicle related to confidential activities

3.     Rentals and the incidental expenses related to the maintenance of safehouses

4.     Purchase or rental of supplies, materials and equipment for confidential operations that cannot be done through regular procedures without compromising the information gathering activity concerned

5.     Payment of rewards to informers (non-employee of government agency concerned) subject to conditions

6.     Uncover / Prevent illegal activities that pose a clear and present danger to agency personnel / property, or other facilities and resources under the agency protection, done in coordination with the appropriate law enforcement agencies

7.     Others that may be authorized by the GAA or other special law/s
