MANILA, Philippines – Hinimok ng House prosecution panel si Vice President Sara Duterte na personal na ipaliwanag kung bakit niya pinayagan na mailipat ang confidential funds sa kanyang security officer, na tinestigo ng witness mula sa Commission on Audit (COA) na isa umanong paglabag sa COA joint circular.
Matatandaan na tumestigo si Xyelene Mae Del Campo, supervising auditor ng Commission on Audit-Intelligence and Confidential Funds Audit Office (Icfao) ng COA at sinabing ang notice of disallowance na inisyu noong Marso ay sakop ang tatlong P125 milyong cash advances na inilabas sa Office of the Vice President (OVP).
Sa press conference, ipinaliwanag ni Benjamin Tolosa Jr., House prosecution counsel at spokesperson, na: “Here it is clear, and we have heard it, that she herself ordered this, which constitutes a direct violation of the joint circular. Nobody else can explain that except the vice president.”
Ayon kay Del Campo, ang basehan ay ang sworn testimony ni dating OVP special disbursing officer (SDO) Gina Acosta sa pagdinig sa Kamara na itinurn-over niya ang pera sa direktiba ni Duterte, kay Col. Raymond Dante Lachica, pinuno ng Vice-Presidential Security and Protection Group.
Ganito rin ang sinabi ni Rep.Renee Co, isa ring House prosecution spokesperson, at sinabing ang bahagi ng joint circular ay nag-iiwan ng maliit na puwang para sa ibang interpretasyon at anumang paliwanag na sasalungat sa requirements ay dapat na direktang manggaling kay Duterte.
“It’s hard to look for a justification — because, as you mentioned, the black letter law is clear in the joint memorandum circular. Whatever the explanation contravening this text, we need to hear it from VP Sara Duterte herself,” ani Co.
Batay sa Joint Circular No. 2015-01, na nangangasiwa sa confidential at intelligence funds, sinabi ni Del Campo na ang SDO ang responsable sa disbursing at cash advance, at walang anumang cash advance para sa confidential funds ang maaaring mailipat mula sa isang accountable officer patungo sa iba.
Ani Del Campo, ang pag-amin ni Acosta ay nagpapakita ng direct violation sa kautusan.
“She said they considered it as an irregularity, as a blatant violation of the rules,” sinabi ni Tolosa patungkol dito.
Paliwanag ni Tolosa, hinahayaan muna ng COA ang ahensya na ipaliwnag ang audit finding bago mag-isyu ng notice of disallowance.
“But as she said… [since] it’s a clear violation of the joint circular which governs the use and liquidation of confidential funds, she immediately issued a notice of disallowance,” dagdag pa.
Ipinunto pa ng prosekusyon na nasa Senate impeachment court na ang desisyon para busisiin ang ebidensya at tukuyin kung lumabag ang transaksyon sa panuntunan at kung anong responsibilidad ang dapat na idugtong sa Bise Presidente. RNT/JGC
