BSKE postponement, kinuwestiyon sa SC

MANILA, Philippines – Hiniling ng election lawyer na si Atty. Romulo B. Macalintal sa Supreme Court (SC) na ideklarang labag sa Konstitusyon ang Republic Act No. 12326, na nagpaliban sa Barangay at Sangguniang Kabataan Elections (BSKE) mula Nobyembre 2, 2026 patungo sa ikalawang Lunes ng Nobyembre 2028. Itinatakda rin ng batas na kada limang taon na ang susunod na BSKE.

Inihain ni Macalintal ang petition for certiorari at prohibition online noong Setyembre 27. Hiniling niya sa SC na maglabas ng temporary restraining order (TRO) o status quo ante order (SQAO) para pigilan ang pagpapatupad ng RA 12326.

Hiniling din niya na utusan ang Commission on Elections (Comelec) na ipagpatuloy ang paghahanda para sa halalan noong Nobyembre 2, 2026, kabilang ang paghahain ng Certificate of Candidacy (COC). Kung hindi na umano maisasagawa ang halalan sa nasabing petsa dahil sa kakulangan ng oras, nais niyang magtakda ang SC ng petsang malapit dito.

Dahil nasa month-long decision-writing period ang SC hanggang Setyembre 30, hiniling ni Macalintal ang special raffle at agarang aksyon sa kanyang mga kahilingan para sa injunctive relief.

Kasama sa mga lumagda sa petition sina lawyers Antonio Carlos B. Bautista, James Kenneth P. Adolor, at William C. Kyle Santos. Kabilang sa mga respondent ang Office of the President sa pamamagitan ng Executive Secretary, Senate, House of Representatives, at Comelec.

Ayon kay Macalintal, ang unang pagpapaliban sa BSKE mula Disyembre 2025 patungong Nobyembre 2026 ay nagbigay na ng isang taong dagdag sa termino ng mga incumbent official. Sa bagong batas, madaragdagan pa umano ito ng dalawang taon.

“This initial delay gave incumbent officials a one-year term extension. The new law pushes the elections further to November 2028, adding another two years to their terms. This results in a cumulative three-year extension for current officials and a three-year denial of the public’s right to vote,” aniya.

Iginiit ni Macalintal na bagama’t maaaring itakda ng Kongreso ang termino ng mga opisyal, hindi umano nito maaaring gamitin ang kapangyarihang iyon upang palawigin ang termino ng kasalukuyang mga opisyal o ipagpaliban nang hindi makatwiran ang halalan.

Kinuwestiyon din niya ang mabilis na pagpasa at publikasyon ng RA 12326, na nilagdaan noong Setyembre 24 at nailathala noong Setyembre 25, 2026. Ayon sa petition, maaaring lumabag din ang batas sa constitutional requirement na iisang subject lamang ang dapat saklawin ng isang batas at malinaw na nakasaad sa titulo nito.

“The November 2026 BSKE may not be postponed on the pretext of fixing the term of office of BSK officials. The reasons in support of RA No. 12326 are unfortunately superficial and farcical, falling within what this Honorable Court has described as insufficient to justify the postponement of an election,” ani Macalintal.

Iginiit din niya na kung limang taon ang magiging termino ng barangay officials, dapat itong ipatupad sa mga mananalong opisyal sa Nobyembre 2, 2026 at hindi retroaktibo sa mga kasalukuyang nakaupo.

Bukod dito, kinuwestiyon niya ang transitory provision ng batas dahil maaari umanong mawalan ng pagkakataong tumakbo muli ang ilang incumbent barangay officials dahil sa pagkakaiba ng “term of office” at “tenure of office.”

“Unless the respondents are enjoined from implementing the assailed law, Macalintal said that his rights, “as well as the rights of those similarly situated, will be irreparably damaged and prejudiced, as they will continue to be governed by leaders for another two years without their mandate and to pay these legislatively appointed officials with public funds, or the people’s money.”

“Hence, Petitioner respectfully seeks this Honorable Court to exercise its inherent authority to issue the injunctive reliefs prayed for herein so as to preserve the exercise of its jurisdiction and ensure that its judgment will not be a mere paper victory. After all, what is sought to be restrained is the perpetration of patently unconstitutional acts that adversely affect the discharge of governmental functions and the very foundations of democracy and republicanism,” dagdag niya.
