Prosecution tinabla ng impeachment court na gawing ebidensiya bank records ni VP Sara

MANILA, Philippines – Tinanggihan ng Senate Impeachment Court nitong Martes ang hiling ng House prosecution panel na gawing ebidensya ang mga bank records ni Vice President Sara Duterte.

Sa ruling ni Presiding Officer Francis “Chiz” Escudero, kahit akusado si VP Duterte, umiiral pa rin ang proteksiyon sa kanya sa ilalim ng  Bill of Rights, partikular ang karapatan laban sa self-incrimination.

Noong Setyembre 8, naghain ang prosecution ng “Request for Admission” na sumasaklaw sa personal na detalye at dating pwesto ni VP Duterte, mga business interests ng asawa nitong si Manases Carpio, at iba’t ibang tax at bank records.

Tinutulan ito ng defense panel at hiniling na burahin sa record ng korte ang nasabing hiling.

Ayon kay Presiding Senator-Judge Francis “Chiz” Escudero, nananatiling protektado ang karapatan laban sa self-incrimination kahit sa impeachment process.

“If the request is allowed, ‘any material and relevant matter of fact’ so requested for answer will be ‘tantamount to compelling’ the respondent to be a witness against herself,” sabi ni Escudero.

Dagdag niya, kung hindi sasagot si VP Duterte, “deemed as an admission of the fact requested to be admitted” ito. At kung sasagot naman nang naka-oath, maaaring maharap siya sa perjury — na aniya’y isa ring uri ng pamimilit na hindi pinapayagan ng Konstitusyon.

“While the impeachment court welcomes the prosecution’s desire to narrow the issues for trial… any such measure to expedite the proceedings must always yield to the protection of the substantial rights of the respondent under the Constitution,” pahayag ni Escudero.

Iginiit din ni Escudero na ang procedural due process ay nangangailangan na patunayan ng prosecution ang mga paratang sa pamamagitan ng kompetenteng ebidensya.

“It cannot shift its burden of proof to the respondent ‘through the simple expedient of a request for admission’,” aniya.

Tinutulan din niya ang argumento ng prosecution na hindi criminal proceeding ang impeachment. Aniya, hindi nito inaalis ang mga constitutional safeguards na dapat ibigay sa respondent.

Patuloy pa rin ang pagdinig ng Senado sa Article II ng impeachment complaint laban kay Vice President Sara Duterte kaugnay ng mga alegasyon ng unexplained wealth at hindi kumpletong deklarasyon sa SALN.  Ernie Reyes
