MANILA, Philippines – Matapos makahanap ng probable cause, naglabas ang Third Division ng Sandiganbayan ng warrant of arrest at hold departure orders (HDOs) laban kay dating House Speaker at incumbent Leyte First District Representative Ferdinand Martin Romualdez, nagbitiw na Ako Bicol party-list Representative Elizaldy “Zaldy” Co, at dalawa pa nitong Lunes, Setyembre 7.
Nagsampa ang Office of the Ombudsman ng kasong plunder laban kina Romualdez, Co, Jocelyn Sereño, na miyembro ng household staff ni Romualdez, at money changer Felecito Guevarra dahil sa umano’y ₱7.4-bilyong “kickback” scheme sa mga flood-control at iba pang proyekto ng pamahalaan.
“The issuance of a warrant of arrest signifies only that, after personally evaluating the records, the Court found probable cause to believe that the accused committed the offense charged,” pahayag ng Third Division.
Ayon sa Sandiganbayan, maaaring maglabas ng warrant kapag may probable cause na nakabatay sa alegasyon ng prosekusyon. Hindi umano ito nangangahulugang napatunayang nagkasala ang mga akusado.
“It does not constitute a determination of guilt. All accused continue to enjoy the constitutional presumption of innocence until their guilt is proven beyond reasonable doubt after a full and impartial trial,” dagdag ng korte.
Binigyang-diin din ng Sandiganbayan na ang mga paglilitis ay dapat nakabatay lamang sa Konstitusyon, mga umiiral na batas, Rules of Court, at ebidensiyang maayos na iniharap sa korte.
Hinimok nito ang mga abogado, litigante at court officer na panatilihin ang integridad ng hustisya, sundin ang mga legal na kautusan at tiyaking maayos ang asal ng kanilang mga kinatawan.
“The Court enjoins all parties to cooperate to ensure that the proceedings are conducted speedily, fairly, orderly, and with full respect for the rule of law,” pahayag ng korte. RNT/MDS
