MANILA, Philippines – Kinuwestyon sa Supreme Court ang legalidad ng probisyon sa unprogrammed appropriations (UA) sa 2024 national budget at pag-tap ng PHP89.9 billion mula sa pondo ng Philippine Health Insurance Corp. (PhilHealth) funds.
Naghain ng petisyon sa SC si Senate Minority Leader Aquilino Pimentel III at Philippine Medical Association bilang mga PhilHealth contributors.
Nakasaad sa petisyon na isang matinding kapinsalaan ito sa bawat Pilipino ma umaasa sa PhilHealth tuwing nagkakasakit.
Kinakailangan anilang eklusibong magamit ang pondo sa ilalim ng Universal Health Care (UHC) Act lalo pa at pahirap ng pahirap ang buhay.
Iginiit ng mga petitioner na ang probisyon sa 2024 General Appropriations Act (GAA) hinggil sa UA ay unconstitutional dahil lumalagpas na ito sa kapangyarihan ng Kongreso na maglaan ng pondo.
“Despite Congress being vested with the powers of appropriation, the constitution demands that the expenditure of these funds have distinct items, qualifications, limitations, or conditions to which they are subject.”
Ayon sa mga petitioner, ang paglihis ng pondo patungo sa unappropriated programs ng national budget ay mistulang ibinibigay ng Kongreso sa Executive branch ang diskresyo na magdesisyun kung paano gagastusim ang pondo na nakalaan partikular sa UHC Act. Teresa Tavares
