MANILA, Philippines – SINABI ng Department of Foreign Affairs (DFA) na walang epekto ang itinatayong isla ng Tsina sa Panganiban Reef (Mischief Reef) at Zamora Reef (Subi Reef).
Sa katunayan, hindi magbabago ang status o kalagayan ng mga ito bilang low-tide elevations at hiniling sa Beijing na tapusin na ang okupasyon o pagsakop at mga aktibidad doon.
Sinabi ni DFA spokesperson for maritime affairs Rogelio Villanueva na ang Panganiban Reef at Zamora Reef ay kapuwa low-tide elevations sa loob ng exclusive economic zone (EEZ) at continental shelf ng bansa, alinsunod sa United Nations Convention on the Law of the Sea (Unclos) at 2016 Arbitral Award.
“As low-tide elevations, the Philippines exercises sovereign rights and jurisdiction over the features, and these can neither be the subject of a sovereignty claim nor capable of appropriation under international law,” ayon sa kalatas ng foreign affairs department.
Tinuran pa rin ng DFA na ang island-building ng Tsina sa parehong bahura ay malinaw na lumabag sa Philippine Maritime Zones Act, o Republic Act No. 12064, at Unclos, gaya ng kinumpirma sa 2016 arbitral ruling.
“The construction of artificial islands also does not alter the legal status of the two features as low-tide elevations,” ayon sa departamento.
Nauna rito, iniulat ng Philippine Coast Guard (PCG) na ilang flare ang pinakawalan ng People’s Liberation Army (PLA) ng China laban sa isang walang armas na PCG aircraft na nagsasagawa ng maritime domain awareness flight sa Kalayaan Island Group (KIG) nitong linggo.
Ayon sa PCG, hinarang sa radyo ng Chinese forces na nakapuwesto sa Zamora (Subi) Reef ang eroplano bago ito lumapag sa Pag-asa Island noong Setyembre 7. Ganito rin ang ginawa ng Chinese forces sa Panganiban (Mischief) Reef.
Sa dalawang insidente, sinabi ng PCG aircrew sa radyo na labag sa international law ang presensya ng Chinese forces sa mga reclaimed feature.
Samantala, nanawagan ang DFA sa Tsina na agad na “cease its illegal occupation and activities” sa Panganiban at Zamora reefs at sumunod sa pinal at nagbubuklod na 2016 Arbitral Award.
“The Department will continue to assert the Philippines’ sovereignty, sovereign rights and jurisdiction in the West Philippine Sea, and champion the Philippines’ legitimate rights and interests in the maritime domain,” ayon sa departamento. KRIS JOSE
