MANILA, Philippines – Tinawag ni Akbayan party-list Representative Perci Cendaña ang mga reklamo ng asawa ni Vice President Sara Duterte na si Manases “Mans” Carpio laban sa kanya bilang isang “classic Duterte” move.
Para kay Cendaña, ang mga reklamo laban sa kanya kaugnay sa impeachment case ng Bise Presidente ay pagganti at layong magpadala ng “chilling effect” sa mga maninita sa umano’y abuse of power.
“Itong filing nung kaso doon sa mga complainants natin sa impeachment, ito’y classic Duterte moves– ‘yung pananakot at pangha-harass. Sabihin na rin nating gumaganti sila doon sa mga tao na ginagawa lang ‘yung kanilang trabaho bilang mga active citizens. The same way na narito kami ngayon, kinasuhan nila for doing our jobs,” sinabi ni Cendaña.
“This is classic Duterte sending a chilling effect to our citizens who will rise up and call them out for their abuse of power,” dagdag pa ng mambabatas.
Kasama ang iba pang respondents na sina Akbayan party-list Representative Chel Diokno at ML party-list Representative Leila de Lima, dumalo si Cendaña sa preliminary investigation hearing nitong Biyernes, Mayo 15 sa mga reklamong inihain ni Carpio sa Office of the City Prosecutor sa Quezon City.
Ang mga reklamo ay may kaugnayan sa paglabag umano sa Bank Secrecy Law, Data Privacy Act, at Anti-Money Laundering Act (AMLA) dahil sa paglalabas ng bank records sa pagtalakay ng House Committee on Justice sa impeachment complaints laban kay Duterte.
Naghain din si Carpio ng reklamo sa ilang indibidwal na nagpasimula ng impeachment complaint laban sa Bise Presidente, kabilang si Fr. Joel Saballa.
Ani Diokno, sila ay “fully confident” sa kanilang legal na posisyon.
Samantala, sinabi ni De Lima na posible para sa kanila na magsampa rin ng kontra reklamo para sa malicious prosecution at perjury.
“Wala kaming nilalabag na batas dito. Wala hong katuturan itong ganitong kaso. And in fact, if I may add, kung ma-dismiss po itong kaso na ‘to, puwede naman po kaming mag-file ng countercharges for damages, for malicious prosecution, even for perjury,” sinabi ni De Lima.
Samantala, sinabi ni Atty. Neil Abayon, legal team ni Carpio, na hindi ito tungkol sa pagbabanta at pagpigil sa katotohanan ngunit tungkol sa accountabulity.
Ani Abayon, ang congressional investigation ay dapat na rumirespeto pa rin sa Bill of Rights ng bawat mamamayan.
“This is not simply about pananakot, but it’s also about accountability. Kasi very clear naman po yung Anti-Money Laundering Act na you cannot disclose any information. You shall not disclose in any manner. So they disclosed it in the Committee on Justice hearing, which was publicly broadcasted, televised nung April 22. At kung i-disclose po kasi ninyo ‘yun, may corresponding penal provisions po ‘yun under the Anti-Money Laundering Act, bank secrecy, and the Data Privacy Act,” sinabi ni Abayon matapos ang hearing.
“It is also clear in the Duterte versus HoR case sa 2025 na the Bill of Rights must be respected in all stages of the impeachment proceedings. So the Bill of Rights, doon po papasok ‘yung right to privacy ni Atty. Mans being a private individual. In simple terms, when they exercise their accountability of public officers, the power, they must also respect the right to privacy of private individuals,” dagdag pa niya. RNT/JGC
