PINALAGAN ng Department of Foreign Affairs at taga-depensa ni Zaldy Co sa Kongreso na walang batayan sa batas ang pagkansela ng passport ni Zaldy Co hangga’t wala raw “court order”.
Ayon sa Philippine Passport Law R. A. 11983 – maaaring kanselahin ang passport kung:
Sec. 10 (b)
1. Upon order of the Court, when the holder has been convicted of a criminal offense…
2. Upon order of the Court when the holder is a fugitive from justice.
3. Upon order of the Court, when the holder is a suspected terrorist…
4. When the passport was acquired fraudulently, tampered with or issued erroneously
5. When a passport is returned to the DFA by other government agencies…
Sa ilalim ng batas, unless fake ang passport ni Zaldy Co o kaya ay ibinalik sa DFA ay dapat may Court order sa pagkansela ng passport. Eh, sa bagal ng pagsampa ng mga kaso laban sa mga sangkot sa ghost flood control projects ay walang magiging batayan ang husgado para kanselahin ang passport. Sorry na lang ba ang taumbayan kung ganoon?
Hindi ba talaga pwede ikansela ng DFA ang passport ni Zaldy Co kung walang Court order pa?
Suriin pa natin mabuti ang batas. Sa naturang provision ay may nakasaad na ganito:
Denial of passport application or cancellation of passport for reasons other than by ORDER OF THE COURT may be appealed to the DFA Secretary.
Ibig sabihin nito ay kung ang pagkansela ng passport ay hindi dahil sa Court order ay pwede mag-apila sa Secretary. So ano ‘yung pwede na pagkansela ng passport kahit walang Court order?
Maliban kung peke o isinoli sa DFA ay may nakasaad sa batas na:
Section 4
In the interest of NATIONAL SECURITY, PUBLIC SAFETY, AND PUBLIC HEALTH, and in accordance with Sections 5 and 10 of this Act, the DFA Secretary, or any of the authorized Consular Officials may deny issuance of a passport or cancel a passport.
Kaya merong pwede paghugutan ang DFA kahit walang Court order. Pero ang tanong ng mga taga-depensa ni Zaldy Co – anong national security, public safety or public health ang involved sa kaso ni Zaldy Co?
Sabi ng mga nagpapakansela ng passport ni Zaldy Co pwede pumasok sa “in the interest of NATIONAL SECURITY”.
Dahil ang alleged involvement niya sa ghost projects at ilan pang corruption issues is connected with the nation’s sovereignty territorial integrity core values, and way of life are enhanced and protected alongside the welfare and wellbeing of the people and the government’s institution.
Tanong: Ang malawak ang pandarambong ba sa kaban ng bayan ay hindi threat sa national security?
Nauunawaan natin na ang DFA Secretary ay hindi kikilos kung hindi uutusan, At baka sabihin din niya na huwag silang utusan bilang ALTER EGO ng Pangulo. Susunod ang kalihim kapag ipinag-utos na ng Pangulo.
