MANILA, Philippines – Nag-renew ng kahilingan para sa pagpapalaya ng dating pangulong Rodrigo Duterte ang kanyang defense team sa isang hindi ibinunyag na bansa, na napapailalim sa “any conditions deemed appropriate” ng International Criminal Court’s Pre Trial Chamber I.
Inihatid ni Nicholas Kaufman, abogado ni Duterte, ang nasabing apela noong Agosto 19.
“For the sake of clarity, the Defence informs the Pre-Trial Chamber that the [REDACTED] continues to affirm its willingness to cooperate with the Court, to accept Mr Duterte onto its territory, and to enforce conditions of release,” nakasaad sa dokumento.
“All the Prosecution’s objections to the [REDACTED] serving as a receiving country for the purposes of interim release are either negligible or negotiable,” dagdag nito.
Nangatuwiran din ang kampo ni Duterte na alam mismo ng Pre Trial Chamber I na sila ay humaharap sa “considerable administrative hurdles” sa pagkuha ng impormasyong kinakailangan upang maglahad ng isang kumpleto at wastong napatunayang hindi isiniwalat na usapin.
Nauna rito, pinagbigyan ng ICC Pre Trial Chamber I ang kahilingan ni Duterte na ipagpaliban ang desisyon sa kanyang apela para sa pansamantalang pagpapalaya.
Sinabi ni Kaufman na ang defense team ay “slow-walked and stymied” mula noong Mayo, at ang ilang resulta ay naibigay lamang sa kanila ilang araw lang ang nakakaraan.
Nanindigan siya na ang pangkat ng pag-uusig ay “nag-mischaracterize” ng isang hindi isiniwalat na materyal bilang “incomplete and should not consequently be relied upon.”
Ito, gayunpaman, ay tinutulan ng prosekusyon, na nagpapanatili na ang pagsusumite ng depensa ay hindi tama.
“The defense submitted that the issue of interim release needed to be resolved urgently, to the extent that it requested that the chamber reduce the Prosecution’s time limit to respond. In a complete reversal, the defense now asks the chamber, again on an urgent basis, not to rule on its request for interim release,” saad ng prosecution.
“The fact that [REDACTED] was incomplete was known to the defense when it filed its request for interim release. It should not now be entitled to delay the adjudication of this matter simply so that it can supplement its original submission,” dagdag nito.
Kasalukuyang nasa kustodiya ng ICC si Duterte matapos siyang arestuhin at ipadala sa The Hague para sa mga krimen laban sa sangkatauhan na ginawa umano niya noong madugong digmaan laban sa droga ng kanyang administrasyon.
