MANILA, Philippines – Naghain ng petisyon ang isang senior high school teacher sa Korte Suprema na humihiling ng paglilinaw sa terminong ‘forthwith’ sa Konstitusyon.
Sa 15 pahinang Motion for Reconsideration nito, nanindigan ang petitioner na si Barry Tayam na ang High Tribunal ay nabigo sa pagbigay ng desisyon sa usapin dahil sa trancendental na kahalagahan nito.
“The use of the term “forthwith” in the recent 97-page Supreme Court decision was only limited to four (4) instances, and the term was neither given specific constitutional definition nor was its meaning elaborated upon in detail. The decision did not provide a clear, time-bound interpretation of the term, leaving its precise meaning whether in days, weeks, or months without a proper constitutional framework,” saad sa MR.
Dagdag pa niya, na ang kakulangan ng isang tiyak na interpretasyon sa desisyon ng SC ay lumilikha ng isang kalabuan na maaring mangailangan ng karagdagang judicial clarification upang magtatag ng isang malinaw na timeline. Jocelyn Tabangcura-Domenden
