MANILA, Philippines – Kinuwestiyon ni Mamamayang Liberal Rep. Leila de Lima nitong Miyerkules ang pananahimik ni Pangulong Ferdinand Marcos Jr. sa biglaang pagtanggal kay Gen. Nicolas Torre III bilang hepe ng Philippine National Police (PNP).
Sa isang House committee on public order and safety briefing kasama ang mga ahensyang nagpapatupad ng batas sa bansa, kinuwestiyon ni De Lima kung bakit si Torre, na nanguna sa pag-aresto kay dating Pangulong Rodrigo Duterte at televangelist Apollo Quiboloy, ay biglang inalis.
Ang mas nakakapagtaka, aniya, ay “we have not heard from the president” na sinabi ni Interior Secretary Jonvic Remulla na “very fond” kay Torre.
Ang utos noong Agosto 25 para sibakin si Torre ay nilagdaan ni Executive Secretary Lucas Bersamin, na naglabas din ng parehong memorandum na pinangalanan si Lt. Gen. Jose Melencio Nartatez Jr., miyembro ng Philippine Military Academy (PMA) class noong 1992, upang palitan si Torre.
“There has been no statement really from the Office of the President or even through ES. Everything we’ve heard were from Remulla,” ani De Lima.
“I wouldn’t know whether we have to believe the official line behind the relief or the dismissal of the former PNP chief. Because the President himself has not spoken,” dagdag niya.
Si Remulla din ang nagsabi na si Torre ay lumampas sa kanyang awtoridad nang maglabas siya ng utos na mag-reassign sa 13 opisyal ng PNP, kabilang ang pagpapalit ng mga puwesto ni Nartatez, noo’y deputy chief for administration at ang pangalawa sa pinakamataas na opisyal, kasama si Lt. Gen. Bernard Banac bilang Area Police Command Western Mindanao director.
“I’m confused about the official line. It’s about exceeding authority, but what exactly did he exceed?” aniya.
Kinwestyon ni De Lima si Napolcom Vice Chair Rafael Calinisan sa legalidad ng pagbaligtad na ito, na binanggit na ang dalawang batas na namamahala sa PNP – Republic Act No. 6975 at RA 8551 – ay hindi nakasaad na maaaring baligtarin ng komisyon ang mga paggalaw ng tauhan na ginawa ng PNP chief.
“The closest I could see here is Section 14, Paragraph 6, which says the commission could ‘affirm, reverse or modify, through the National Appellate Board, personnel disciplinary actions involving demotion or dismissal from the service imposed upon members of the Philippine National Police by the Chief of the Philippine National Police…I don’t think it’s the one applicable here,” aniya.
“A law is superior over resolutions or circulars,” dagdag niya. “Please convince me that Napolcom was perfectly in its powers when it reversed the actions of the former police chief.”
Nanindigan si Calinisan na ang pagbaligtad ay ganap na legal, na sinasabi na ang mga implementing rules and regulations para sa RA 6975 ay nagsasaad na ang administratibong kontrol ng komisyon sa PNP ay sasaklaw, ngunit hindi limitado sa, ang pagpapahayag ng mga patakaran at pamantayan, mga plano at programa, ang pagrepaso, pag-apruba, pagbabalikwas, o pagbabago ng mga plano at programa.
