MANILA, Philippines – Tinanggihan ng Office of Public Counsel for Victims (OPCV) ng International Criminal Court (ICC) ang bid ni dating pangulong Rodrigo Duterte para sa “indefinite adjournment” ng lahat ng legal na paglilitis laban sa kanya, at sa halip ay hinimok ang assessment ng kanyang kondisyong medikal upang suriin ang kanyang pagiging angkop na humarap sa paglilitis.
Sinabi ng Principal Counsel ng OPCV na si Paolina Massidda sa isang 14 na pahinang paghahain na may petsang Oktubre 8 na ang kasalukuyang pagsusumite ng depensa tungkol sa kalusugan ni Duterte ay hindi nakakatugon sa pagpapaliban ng mga legal na paglilitis laban sa kanya.
“She submits that the Suspect’s state of health should be properly assessed by the Chamber, as a matter of urgency to avoid delays in the proceedings, appointing independent expert(s) to evaluate his faculties in relation to his ability and fitness to participate in the next stages of the proceedings,” nakasaad sa dokumento.
“All possible measures should be considered and exhausted before the Chamber can contemplate staying proceedings against the Suspect on an indefinite basis, as not only the defendant, but victims and the international community as a whole have a vested interest in seeing proceedings progress where possible,” ayon sa OPCV.
“The interests of justice indeed require that individuals who stand suspected or accused of having committed some of the gravest crimes of concern to the international community be tried fairly and expeditiously. Fairness and expeditiousness are also entitlements enjoyed by the victims of atrocity crimes who have the right to truth and accountability,” dagdag nito.
“In the Legal Representative’s view, the assessment of Mr. Duterte’s health conditions has to be conducted as a matter of urgency in order to avoid delays in the proceedings,” nakasaad pa sa dokumento.
Ang dating Pangulo, na nakakulong sa The Hague, Netherlands para sa mga kaso ng crimes against humanity of murder mula noong Marso, ay dapat humarap sa pre-trial chamber ng ICC para sa kumpirmasyon ng pagdinig ng mga kaso noong Setyembre 23.
Sinuspinde ng chamber ang pagdinig matapos ipangatuwiran ng defense team ni Duterte na hindi siya karapat-dapat sa paglilitis, na binanggit ang cognitive deterioration na naging dahilan upang hindi niya maalala ang mga kaganapan, petsa, at maging ang mga miyembro ng kanyang sariling pamilya.
Gayunpaman, ang mga kamakailang panayam ng pamilya Duterte ay nagpakita na ang dating pangulo ay nakapagsalita tungkol sa mga kasalukuyang isyu, tulad ng katiwalian sa flood control projects. RNT/MND
