MANILA, Philippines – Pinayagan ng Sandiganbayan ang hiling ng Office of the Ombudsman na bawiin ang anim na graft cases na inihain laban kina dating Budget Undersecretary Lloyd Christopher Lao at iba pang opisyal ng Pharmally Pharmaceutical Corp. kaugnay sa umano’y maanomalyang pagbili ng mahigit P8 bilyong halaga ng COVID-19 supplies sa kasagsagan ng pandemya.
Sa resolusyon na may petsang Nobyembre 7, kinatigian ng korte ang authority to revisit ng Ombudsman at binaliktad ang naunang desisyon.
“Settled is the rule that a sitting Ombudsman has the power to revoke or alter the rulings of a predecessor within the bounds of law,” sinabi ng korte.
Ang mosyon ay inihain ni Ombudsman Jesus Crispin Remulla, na nagbabaliktad sa aksyon sa ilalim ni dating Ombudsman Samuel Martires.
Nag-ugat ang mga reklamo sa multi-bilyong pisong procurement ng PPE, surgical masks, face shields, at RT-PCR test kits mula sa Pharmally noong 2020.
Mayroon lamang P625,000 paid-up capital ang kompanya ngunit nakakuha ng mahigit P8 bilyon sa kontrata mula sa Procurement Service of the Department of Budget and Management (PS-DBM), na dating pinamumunuan ni Lao.
Kalaunan ay pinuna sa pagdinig ng Senado ang mga transaksyon na tinawag na maanomalya dahil sa overpricing at nakatanggap din ng preferential treatment ang Pharmally sa pamamagitan ni dating presidential adviser Michael Yang.
Sa pag-upo sa pwesto, nais ni Remulla na bawiin ang mga kaso upang mabigyang-daan ang reassessment at reinvestigation ng mga ebidensya.
Bagamat ang Ombudsman ang may full discretion sa pagtukoy sa probably cause, iginiit ng Sandiganbayan na may kontrol ito sa case transfers sa korte sa oras na maihain na ito.
Sa kabila nito, nakita pa rin ang merito sa withdrawal at sinabing hindi ito batay sa kakulangan ng probable cause ngunit sa pangangailangan na suriin ang mga reklamo upang maging matibay ito sa paglilitis.
“This Court sees no inconsistency between its previous finding of probable cause for the purpose of issuing warrants of arrest and in allowing the withdrawal of the Informations.”
Kinontra rin ng korte ang mga argumento na inihain ng mga akusado na ang pagbawi sa mga kaso ay magdudulot ng “inordinate delay” at lalabag sa kanilang karapatan sa mabilis na disposisyon ng mga kaso.
“After careful consideration of the facts, allegations, and records of these cases, this Court deems it appropriate to grant the withdrawal of the Informations despite the previous finding of probable cause and the earlier issuance of the warrants of arrest,” sinabi ng korte.
