MANILA, Philippines – Idinetalye ni Senador JV Ejercito sa pagdinig sa Senado kung paano nang-iiscam ang mga tiwaling tauhan ng Bureau of Internal Revenue (BIR) sa mga taxpayer sa pamamagitan ng letters of authority (LOAs).
Isa umano sa mga modus ng ilang empleyado ng BIR ay ang paglalabas ng iba’t ibang LOA sa loob lamang ng isang taxable year o succeeding taxable years.
Ani Ejercito sa pagdinig ng Senate blue ribbon committee, ang mga impormasyong ito ay nakarating sa kanyang opisina.
Tinukoy niya ang kaso ng isang taxpayer sa Quezon City na inisyuhan ng apat na LOA sa loob lamang ng anim na buwan.
Mayroon pang isang taxpayer ang naisyuhan ng apat na LOA ng BIR Laoag office — tig-dalawa sa kanilang mini grocery at eatery.
“He is just an ordinary business owner working hard for his family and their three children. They even had to use a bank loan to pay the BIR,” sinabi ng senador patungkol sa ikalawang kaso.
Mayroon din aniyang “bloated” tax assessments na walang basehan na isa pang modus ng ahensya.
“The report we received said that a BIR examiner in the City of Manila allegedly offered to settle the LOA for ‘₱400,000 all-in.’ Because they refused to give the requested bribe, the examiner allegedly issued an assessment amounting to ₱13 million,” anang senador.
“This was reportedly puzzling because the business’ gross sales were only ₱12 million — even before deducting expenses — yet the assessment was higher than the actual earnings. The computation presented also reportedly lacked sufficient supporting documents or justification,” dagdag ni Ejercito.
Ang ikatlong modus ay ang “extortion in the guise of compromise” na ayon kay Ejercito ay naranasan ng isang korporasyon sa Bulacan.
Batay sa report ng kaniyang opisina, mismong ang tax examiner ang nag-aalok na babaan ang halaga para sa ₱30-million deficiency.
“They allegedly offered only ₱1.2 million — ₱800,000 ‘for the boys’ and ₱400,000 was reflected on the receipt. The kickback was even larger than the amount on the receipt!”
“In another report, the examiner reportedly bluntly asked, ‘What’s the budget?’” pagpapatuloy nito.
Kamakailan ay sinabi na ni Ejercito sa panayam sa media ang 70/30 modus kung saan mahigit 70 percent ng assessment amount na ibinabayad ng taxpayer ay naibubulsa lamang ng ilang tauhan ng BIR at tanging 30% lamang ang lumilitaw sa rekord ng pamahalaan.
Kasunod ng reklamo, agad na ipinag-utos ng Department of Finance ang suspensyon ng lahat ng field audits at related operations ng BIR. RNT/JGC
