MANILA, Philippines -SINABI ni Executive Secretary Ralph Recto, araw ng Huwebes, Enero 15 na ganap na nakasunod ang gobyerno sa kapasyahan ng Korte Suprema ukol sa paglilipat ng Philippine Health Insurance Corp. (PhilHealth) funds, muling inulit nito ang kanyang pagiging insodente sa gitna ng ga bagong reklamo na inihain laban sa kanya sa Office of the Ombudsman.
“We respect the right of any individual or group to seek legal remedies and to avail themselves of the processes provided under our laws,” ang sinabi ni Recto isang kalatas.
“The issue has already been addressed by the Supreme Court, and the government has fully complied with its ruling. Consistent with this, funding for PhilHealth has since been restored and even augmented in order to better serve our countrymen,” aniya pa rin.
Nagpalabas ng pahayag si Recto matapos na maghain ng plunder, technical malversation, at graft complaints ang koalisyon ng mga doktor, health advocates, at mga abogado laban sa kanya at kay dating PhilHealth president Emmanuel Ledesma Jr.
Ang reklamo ay iniuugnay sa pagipat sa P60 billion sa PhilHealth’s excess reserve funds sa national treasury.
Sa isang 31-page complaint, hiniling ng grupo sa Ombudsman na magsagawa ng preliminary investigation para madetermina ang posibleng criminal, civil, at administrative liability, kabilang na ang grave misconduct.
Sinabi ng mga complainants na ang nasabing paglilipat ay paglabag sa Republic Act 7875, o National Health Insurance Act of 1995, at Republic Act 11223, o Universal Health Care Act.
Si Recto, isang finance secretary nang panahon nang ilipat ang pondo, nanindigan na umakto lamang siya ” in good faith” at sa ilalim ng congressional authority.
“Let me also reiterate my innocence, as opined by Supreme Court Justices, that no criminal liability may attach to me, as former Secretary of Finance, for acting in good faith and in accordance with a direct mandate from Congress in ordering the remittance of PhilHealth’s unused funds,” ang sinabi pa rin ni Recto.
Tinuran pa ng mga complainants na ang pondo na inilipat sa national treasury ay inilaan sa unprogrammed appropriations sa ilalim ng 2024 General Appropriations Act, di umano’y naging dahilan ng llegedly causing damage and prejudice to PhilHealth members and the public.
Sa ulat, inutusan ng Korte Suprema ang pamahalaan na isauli sa Philippine Health Insurance Corporation (PhilHealth) ang P60 bilyong sobrang pondo na naunang inilipat sa national treasury. Para matiyak na maibabalik ang pondo, kasama sa utos ng mga mahistrado na isama ang naturang halaga sa 2026 General Appropriations Act (GAA).
SA 136-pahinang desisyon, idineklara ng SC En Banc na walang bisa ang Special Provision 1(d), Chapter XLIII ng 2024 GAA, ang Finance Circular No. 003-2024, at ang paglilipat ng P60 bilyon dahil ipinatupad umano ang mga ito na may labis na pag-abuso sa kapangyarihan na katumbas ng kawalan o sobrang hurisdiksyon.
Pinahihintulutan ng naturang Special Provision 1(d) ang pagbabalik ng sobrang pondo ng mga government-owned o controlled corporations sa national treasury, habang inatasan naman ng circular ng Department of Finance (DOF) ang paglipat ng kabuuang P89.9 bilyon mula PhilHealth patungo sa national treasury.
Bilang pagtugon ng PhilHealth sa utos ng DOF, nauna na nitong inilipat sa national treasury ang P60 bilyon na bahagi ng P89.9 bilyon.
Dahil dito, inatasan ng SC ang Kongreso, ang Department of Finance, at ang Executive Secretary na isama ang P60 bilyon sa item sa 2026 GAA para matiyak na maibalik ang naturang halaga sa PhilHealth.
Samantala, ipinag-utos din ng SC na hindi na ilipat pa sa treasury ang nalalabing P29.9 bilyon ng PhilHealth.
“We remain confident that the facts and the law are clear, and that the appropriate institutions will evaluate any allegations fairly and objectively,” ang sinabi ni Recto.
“For our part, we will continue to uphold the rule of law, respect due process, and work to uplift the lives of our kababayan. I will not get distracted by political noise. The work of improving government performance and services is my priority,” aniya pa rin. Kris Jose
