MANILA, Philippines – Hindi lalahok sa pamamagitan ng video conference si dating Pangulong Rodrigo Duterte sa confirmation of charges hearing sa International Criminal Court (ICC) na nakatakdang magsimula sa Pebrero 23, ayon sa kanyang defense counsel na si Nicholas Kaufman noong Martes.
“The former President will not participate in the confirmation hearing through video-conferencing. Nor did the former President willingly appear by way of such technology at his initial appearance,” sinabi ni Kaufman sa isang ulat.
Ayon sa ICC, gaganapin ang pagdinig mula alas-10 ng umaga hanggang alas-3 ng hapon sa oras ng The Hague (alas-5 ng hapon hanggang alas-10 ng gabi sa oras ng Pilipinas) sa harap ng Pre-Trial Chamber I sa Courtroom I.
Itinakda naman ang mga kasunod na pagdinig sa Pebrero 24, 26, at 27. Sa mga pagdinig, ihaharap ng prosekusyon, depensa, at mga abogado ng mga biktima ang kanilang mga argumento sa mga hukom.
Sinabi ni Kaufman na humiling ang co-counsel ni Duterte na si Attorney Salvador Medialdea ng postponement upang mabigyan siya ng pagkakataong makarating sa The Netherlands at kumatawan kay Duterte bilang piniling abogado nito.
“His co-counsel at the time, Attorney Salvador Medialdea, requested a postponement of that hearing fixed for a Friday to an in-court hearing on the following Monday, to allow me to arrive in The Netherlands, to represent him as his counsel of choice, and specifically to raise the issue of legal competence,” ani Kaufman.
“This request was perfunctorily denied. Then, still dazed from hospital medication, in a tasteless suit not of his own, he was positioned, slumped in front of a camera, to be told that a prison doctor had deemed him ‘fully mentally aware and fit’,” dagdag niya.
Tumanggi si Kaufman na magbigay ng karagdagang detalye nang tanungin kung personal bang haharap si Duterte o tatalikuran ang kanyang karapatang dumalo.
Naglaan ang ICC ng oras para sa oral arguments, kung saan may 30 minuto ang prosekusyon para sa opening statements, dalawang oras at 30 minuto para sa submissions, at 30 minuto para sa closing. May 30 minuto naman ang mga abogado ng biktima para sa opening, isang oras at 30 minuto para sa submissions, at 30 minuto para sa closing. Ang depensa ay binigyan ng 30 minuto para sa opening, tatlong oras at 30 minuto para sa submissions, at 30 minuto para sa closing. Maaaring magbago ang iskedyul depende sa daloy ng pagdinig, ayon sa ICC.
“The purpose of the confirmation of charges hearing is to determine whether there is sufficient evidence to establish substantial grounds to believe that the person committed each of the crimes charged,” ayon sa ICC.
“If one or more of the charges are confirmed, the case will be transferred to a Trial Chamber, which will conduct the subsequent phase of the proceedings: the trial,” dagdag nito.
Kasalukuyang nakakulong si Duterte sa ICC Detention Center sa Scheveningen, The Hague, kaugnay ng kasong crimes against humanity na may kinalaman sa mga pagpatay sa ilalim ng kanyang war on drugs noong siya ay alkalde ng Davao City at kalaunan bilang Pangulo ng Pilipinas.
Inihayag din ng ICC na kabilang sina Senators Ronald “Bato” dela Rosa at Bong Go; mga dating opisyal ng pulisya na sina Vicente Danao, Camilo Cascolan, Oscar Albayalde, at Isidro Lapeña; dating National Bureau of Investigation director Dante Gierran; dating Justice secretary Vitaliano Aguirre II; at iba pang matataas na opisyal ng Philippine National Police bilang mga umano’y co-perpetrators sa isang “common plan” upang “neutralize alleged criminals” sa pamamagitan ng “violent crimes including murder.” RNT
