MANILA, Philippines – Kinuwestyon ng legal team ni Vice President Sara Duterte ang naging pagdinig ng House Committee on Justice nitong Huwebes, Abril 30, at sinabing kulang sa ebidensya at hindi umano pumapasa sa standard ng probable cause ang mga paratang laban sa kanya.
Ayon sa abogado niyang si Paul Lawrence Lim, na tumatayong counsel sa reklamo sa National Bureau of Investigation (NBI), mahihina at kaduda-duda ang mga paratang gaya ng inciting to sedition at grave threats na ipinakita sa pagdinig.
“The presentation on the Vice President’s alleged commission of inciting to sedition and grave threats at yesterday’s House Committee on Justice hearing publicly reveals the paucity of the charges against her,” ani Lim.
Dagdag pa niya, ang mga ebidensya ay tila “curated” at “spliced,” habang may mga konteksto umanong hindi isinama. Inakusahan din niya ang pagdinig na pinapalitan ang katotohanan ng opinyon at haka-haka.
“Evidence is curated, even spliced. Context is ignored. Opinion is substituted for facts. Guesswork is presented as investigation results,” dagdag niya.
Giit ng kampo ni Duterte, hindi raw sapat ang ipinakitang materyales para makabuo ng probable cause o kaso na may “reasonable certainty of conviction.”
“These cannot be the foundation for probable cause, much less a prima facie case with reasonable certainty of conviction,” ani Lim. “Simply repeating a conclusion, no matter how vehemently, does not make it true,” dagdag pa niya.
Tinanggihan din ng kampo ang ugnayan umano ni Duterte sa mga pahayag laban kay Pangulong Ferdinand Marcos Jr., at sinabing ito ay haka-haka lamang.
Ayon pa kay Lim, ang pagtatangkang iugnay ito ay isang “gigantic leap in logic” at pagtalikod sa tamang prinsipyo ng ebidensya.
“Similarly, the attempt to create a causal link or relationship between the Vice President and alleged comments against the President demands a gigantic leap in logic and abandonment of basic evidentiary principles,” aniya.
Tinawag din nilang “fishing expedition” ang imbestigasyon ng Kamara, na layuning magmukhang may laman ang umano’y mahihinang impeachment complaints.
“If there is anything that was proved by yesterday’s proceedings, it is to confirm that it is and has always been a fishing expedition aimed at giving a semblance of substance to the defective impeachment complaints,” ani Lim.
Sinabi rin ng kampo ni Duterte na ang mga paratang ay haharapin nila sa tamang legal na proseso, kabilang ang NBI complaint proceedings, kung saan inaasahan daw na ebidensya ang mananaig. RNT/MND
