MANILA, Philippines — Posibleng umabot sa Supreme Court ang impeachment trial ni Vice President Sara Duterte kung hahatulan siya ng Senate impeachment court nang mas mababa sa 16 boto, ayon kay constitutionalist at retired Supreme Court Justice Adolfo Azcuna.
Ayon kay Azcuna, ang Senado ang may “the sole power to try and decide the impeachment case,” ngunit maaari pa ring dalhin sa Korte Suprema ang usapin kung may grave abuse of discretion.
“Supposing the threshold should be 16, but the vote is only 15, and, but the Senate tribunal enters a judgment of conviction saying that the threshold has been met, then that, can be questioned as a grave abuse of discretion, in my view,” ani Azcuna.
Sinabi naman ni dating Senate President Franklin Drilon na kung dadalhin sa Supreme Court ang usapin, kailangan munang maresolba kung may hurisdiksyon ang mataas na hukuman sa impeachment case.
“The Supreme Court may or may not entertain the petition, but that is an issue, which, on its surface — on its face can be brought to the Supreme Court,” pahayag niya.
Ayon kay political scientist Julio Teehankee, malaki ang posibilidad na umabot sa Supreme Court ang kaso maliban na lamang kung makapaghaharap ang prosecutors ng kasong makakakumbinsi sa mahigit 16 senator-judges na bumoto para sa conviction. Binanggit niya ang sitwasyon nina Sen. Jinggoy Estrada, na nakakulong at nahaharap sa graft cases; Sen. Ronald “Bato” Dela Rosa, na nagtatago; at Sen. Rodante Marcoleta, na posibleng maharap sa plunder complaint.
“At the rate things are going nga, ‘no?” ani Teehankee.
Ang Duterte trial ang magiging ikatlong full-blown impeachment trial sa kasaysayan ng bansa at ikatlong pagkakataon na hindi lahat ng 24 senador ay uupo bilang judges.
Ayon kay Drilon, hindi nasagot sa impeachment trials nina dating President Joseph Estrada at dating Chief Justice Renato Corona kung ang two-thirds vote ay dapat ibatay sa lahat ng 24 senador o sa bilang lamang ng mga nakaupong senator-judges. Naalis sa puwesto si Corona matapos bumoto ang 20 senador para sa conviction at tatlo ang bumoto para sa acquittal.
Sinabi ni Azcuna na naniniwala siyang dapat isama sa bilang ang suspended senator gaya ni Estrada.
“What the Supreme Court said in one case is that someone suspended cannot hold public office. What it means is he cannot exercise the public office, but the position is still occupied by him or her,” ani Azcuna.
Nagbabala naman si Drilon sa “absurdities” kung laging ibabatay sa 24 senador ang voting threshold.
“Suppose 10 senators will resign. Then you would only have 14 senators. If there are only 14 senators, are you telling me that we cannot enforce an accountability measure in the Constitution, which is impeachment?” pahayag niya.
Ayon kay Drilon, dapat umayon ang threshold sa Avelino v. Cuenco ruling tungkol sa Senate quorum, at kung hindi makalalahok sina Dela Rosa at Estrada, dapat ibatay ang two-thirds vote sa 22 senador.
“Where, the particular senator is in hiding, as in the case of Senator Bato, or under detention, as in the case of, Senator Jinggoy, I do not believe that the two-thirds should be based on 24, but on 22,” ani Drilon.
Iginiit naman nina Senate President Sherwin Gatchalian at Sen. Panfilo Lacson na 16 boto pa rin ang kailangan para sa conviction. Sinabi ni Lacson na ang impeachment court bilang collegial body ang magpapasya batay sa majority ng senator-judges.
Iminungkahi rin ni Lacson na humanap ng paraan upang makalahok ang suspended at detained senators, gaya ng pagtingin na legislative functions lamang nila ang suspendido.
“Otherwise, it’s going to be a crisis. There might as well be no impeachment trial,” ani Lacson.
Nagbabala naman si Senate Minority Leader Alan Peter Cayetano sa majority laban sa pagpapababa ng threshold.
“Are we going to really have an impartial trial, or aayusin at luto na? Are we going to tell [people] the truth that dapat 16 to convict, or babawasan ba ng anim na senador para maging 12 na lang?” pahayag niya.
Nagbabala rin si Teehankee na maaaring hindi tanggapin ng publiko ang anumang hakbang na magmumukhang pagpigil sa mga senador na itinuturing na kaalyado ni Duterte na makalahok sa trial.
“Baka hindi rin ‘to tanggapin ng publiko, ‘no?” ani Teehankee. RNT
