MANILA, Philippines – Nangako si Senator-judge Francis “Chiz” Escudero na gagampanan nito ang pagiging presiding officer ng Impeachment Court na lumilitis kay Vice President Sara Duterte nang walang kinikilingan at pagkiling sa Saligang Batas.
Sa kanyang manipestasyon pagakatapos mahalal bilang presiding officer ng impeachment court sa botong 12-8, sinabi ni Escudero na wala siyang kakatakutan o papaburan sa “pagmamaneho” ng paglilitis laban kay Duterte.
“As Presiding Officer, I shall do my part to uphold the fairness and integrity of this process and shall see it through to its proper conclusion,” ayon kay Escudero.
Tiniyak ito ni Escudero sa harap ng kasamahang senator-judges na pumili sa kanya upang pangunahan ang pagmamaneho ng paglilitis kay Duterte, kauna-unahang bise president ng Pilipinas na nahaharap sa impeachment at tanging opisyal ng pamahalaan na naharap sa dalawang sunod na impeachment.
“I did not seek nor did I ask for this responsibility. But neither will I shirk from fulfilling this duty without fear or favor,” ayon sa beteranong senador.
Dahil dito, pinasalamatan ni Escudero ang kasamahan partikular ang 12 senador na bomoto sa kanya upang maging presiding officer na nasa sentro ngayon ng pambansang atensiyon, historic comparison at matulis na pagkakahati-hait sa pulitika nang simulan ng Sendao ang papel nito bilang impeachment court.
Aniya, pinakamasaklap na gagawin ang pagtatanggal ng isang halal na opisyal bago magtapos angs sariling termino sa ating demokrasyang konstitusyunal.
“This is why the trial must be guided with prudence, tempered by caution, and marked with unquestionable impartiality. We must avoid even the appearance of impropriety and observe the cold neutrality of an impartial judge at all times,” aniya.
“May I therefore caution my fellow Senator‑judges, the prosecutors, the respondent, and their respective counsels and witnesses to refrain from making any comments and disclosures to the public pertaining to the merits of the trial,” dagdag ng senador.
Giit pa ni Escudero na ibibigay kay Bise Presidente ang “presumption of innocence” na kailangan patunayan ng prosekusyon. “The burden of proof rests upon the Prosecution. It does not and will not shift.”
“Hindi tayo nandito upang itaguyod ang anumang pampulitikal na adyenda. Hindi tayo narito upang paglingkuran ang kagustuhan ng alinmang panig. Narito tayo upang alamin ang katotohanan, at sa pamamagitan nito, magpairal ng hustisyang walang kinikilingan,” ani Escudero.
Ikalima si Duterte sa kinasuhan ng impeachment ng Mababang Kapulungan sa ilalim ng 1987 Constitution. Una si dating Pangulong Joseph Estrada noong 201, pangalawa si Ombudssman Merceditas Gutierrez noong 2011 na nagbitiw bago simulan ang paglilitis.
Ikatlo si dating Chief Justice Renato Corona noong 2011 na na-convict at natanggal sa tungkulin at ikaapat si dating Commission on Elections Chairman Andres Bautista noong 2017, na nagbitiw bago simulan ang paglilitis. Ernie Reyes
