MANILA, Philippines — Humiling si Senador Jinggoy Estrada sa Sandiganbayan Fifth Division na payagan siyang makapagpiyansa kaugnay ng ₱573.75-milyong plunder case dahil sa umano’y pagkakasangkot niya sa mga maanomalyang flood control project.
Inihain ni Estrada ang petisyon dalawang araw matapos ibasura ng anti-graft court ang kaniyang motion to fix bail. Sinabi ng hukuman na premature ang kahilingan dahil hindi pa siya naghahain noon ng pormal na petition for bail.
“There is no strong evidence that during the period of July of 2024 to March of 2025, accused Estrada, directly or indirectly, through a combination or series of overt or criminal acts, amassed, accumulated or acquired ill-gotten wealth or unjustly enriched himself in the amount of P573,750,000, or any amount for that matter,” nakasaad sa mosyon ni Estrada.
Itinanggi rin niya na humingi o tumanggap siya ng kickback mula kay dating Department of Public Works and Highways Undersecretary Roberto Bernardo o sa mga kinatawan nito kaugnay ng mga flood control at infrastructure project.
“There is no strong evidence that accused Estrada willfully and unlawfully demanded, solicited, or received, directly or indirectly, from [then] DPWH Undersecretary Roberto Bernardo, or the latter’s aide, driver, or representative, any so called commitment, kickbacks, or commissions, whether in the amount of 25% of the total project budget of P360,000,000 o otherwise, either by reason of his position as Senator or in connection with any DPWH flood control or infrastructure project,” ayon sa petisyon.
Iginiit din ni Estrada na walang ebidensiyang humingi siya ng katulad na pabor mula kay dating Bulacan First District Engineering Office District Engineer Henry Alcantara.
Itinanggi rin niya ang pakikipagsabwatan kina dating Public Works Secretary Manuel Bonoan at mga kapwa akusadong sina Denryl Cortuna, Manny Bulusan, at Arturo Gonzales Jr. upang maisingit ang mga flood control at infrastructure project sa panukala at aprubadong 2025 national budget.
“There is no strong evidence of any conspiracy to commit plunder or any other crime between accused Estrada and his co-accused Manuel Bonoan, Denryl Cortuna, Manny Bulusan, and Arturo Gonzales, Jr. Because the evidence of his guilt is not strong, accused Estrada should be admitted to bail,” nakasaad sa kaniyang mosyon.
Nauna nang sinabi ng Sandiganbayan na ang piyansa para sa isang akusado sa capital offense gaya ng plunder ay nakasalalay sa desisyon ng hukuman at maaari lamang payagan matapos mapatunayan sa pagdinig na hindi matibay ang ebidensiya ng pagkakasala.
Bukod sa plunder, nahaharap din si Estrada sa dalawang kasong graft kaugnay ng umano’y flood control corruption scandal—isa sa Fifth Division at isa pa sa Second Division.
Ito na ang ikatlong pagkakataon sa loob ng 25 taon na naharap si Estrada sa plunder at iba pang kaugnay na kaso. Santi Celario
