MANILA, Philippines – Sinabi ni Sen. Rodante Marcoleta nitong Lunes, Setyembre 21, na hindi na siya nakahilig na lumahok sa impeachment trial ni Vice President Sara Duterte kung magpapatuloy ang Senate impeachment court sa paraang sa tingin niya ay labag sa Konstitusyon.
Tinutulan ni Marcoleta ang pagtatalaga kay Sen. Francis “Chiz” Escudero bilang presiding officer. Giit niya, ang Senate President ang dapat mamuno sa impeachment trial maliban kung ang Pangulo ang respondent.
Tinutulan din niya ang posibilidad na gamitin ang internal rules ng Senado upang baguhin ang constitutional requirement sa bilang ng boto para sa conviction.
“I am no longer inclined to seek participation in the impeachment trial of Vice President Sara Duterte, including its eventual deliberations leading to the voting, if the Impeachment Court ultimately proceeds in a way that will desecrate the Constitution,” ani Marcoleta.
“In my humble view, the Senate cannot invoke its internal rules to rewrite a voting threshold prescribed by the Constitution,” dagdag niya.
Sa ngayon, sinusuri ng impeachment court ang bilang ng boto na kailangan para mahatulan si Duterte. Una nang nagpasya si Escudero na kailangan ang 16 na boto, o two-thirds ng 24 na senador. Nakatakdang dinggin ng korte ang oral arguments ukol dito sa Miyerkules.
Umiikot ang usapin sa interpretasyon ng probisyon ng Konstitusyon na nangangailangan ng “two-thirds of all the Members of the Senate,” lalo na dahil may ilang senator-judge na hindi nakadalo sa mga paglilitis.
“If the Impeachment Court eventually adopts a threshold that deviates from the Constitution’s plain language and meaning, while the trial proceeds under a presiding authority of doubtful constitutional validity, these twin violations would fatally taint the legitimacy and integrity of the impeachment trial,” ani Marcoleta.
Sinabi rin niya na maaaring kuwestiyunin sa Konstitusyon ang anumang desisyong magmumula sa naturang proseso. Nauna na rin niyang sinabi na hindi siya hihingi ng furlough upang dumalo sa pagdinig tungkol sa voting threshold. RNT/MDS
