MANILA, Philippines – Iginiit ni Davao City Rep. Paolo Duterte na Supreme Court na ang dapat magpasya kung naaayon sa Konstitusyon ang bagong ruling ng Senate impeachment court sa pagkukuwenta ng two-thirds vote na kailangan upang ma-convict ang kanyang kapatid na si Vice President Sara Duterte.
Kinuwestiyon ni Duterte ang naging interpretasyon ng impeachment court matapos nitong alisin ang nakapirming 16-vote requirement at ibatay ang threshold sa bilang ng mga senator-judge na legal at aktuwal na may kakayahang makilahok sa proceedings.
“Is it within its authority as the impeachment court? But the bigger question remains—does that interpretation conform to the Constitution? The Constitution says conviction requires the concurrence of two-thirds of ALL the Members of the Senate,” ani Duterte.
Sa ilalim ng 1987 Constitution, nakasaad na walang impeached official ang maaaring ma-convict nang walang concurrence ng two-thirds ng lahat ng miyembro ng Senado. Nakasaad din dito na ang Senado ang may sole power na litisin at desisyunan ang impeachment cases.
Para kay Duterte, kung dadalhin ng kampo ng Bise Presidente sa Korte Suprema ang usapin, dapat hayaang ang mga mahistrado ang tumukoy kung naaayon sa Saligang Batas ang interpretasyon ng Senate impeachment court.
“If the affected party chooses to bring that question before the Supreme Court, then let the High Court decide whether the Senate’s interpretation is consistent with the fundamental law,” ani Duterte.
“At the end of the day, positions in government are temporary. The Constitution is not,” dagdag niya.
Nauna nang bumoto ang impeachment court nang 13-1 upang baligtarin ang July 6 ruling na nagtakda ng fixed 16 votes para sa conviction, habang anim na senator-judge ang hindi nakilahok sa botohan.
Samantala, magkakaiba ang naging pananaw ng mga inimbitahang amici curiae sa usapin. Sina retired Chief Justices Artemio Panganiban, Reynato Puno at Hilario Davide Jr. ay nagsabing hindi kailangang manatiling nakapirmi sa 16 ang threshold, habang iginiit ni retired Associate Justice Adolfo Azcuna na dapat itong ibatay sa buong 24-member Senate.
Nauna na ring sinabi ng defense team ni Duterte na maaari nitong gamitin ang available legal remedies upang kuwestiyunin ang bagong ruling. RNT
