MANILA, Philippines – Hindi nangangahulugan na makikita kung paano ang pagboto ng senator-judges sa conviction ni Vice President Sara Duterte sa 13-1 boto na nagbabasura sa naunang ruling ni Presiding Officer Francis “Chiz” Escudero, ayon kay Senate President Sherwin Gatchalian nitong Huwebes.
Sa pahayag, nilinaw ni Gatchalian na ang 13-1 na boto ay hindi nangangahulugan kung paano boboto ang senator-judges kung i-co-convict o i-a-acquit si Vice President Sara sa impeachment trial.
“No, that’s far off. Because when it comes to the verdict, it’s about the evidence, it’s about the testimonies, it’s about how the prosecution and defense will present their cases,” ani Gatchalian sa ambush interview.
“That’s not the vote to convict. That’s also not the vote to acquit,” dagdag niya.
Sinabi ito ni Gatchalian matapos tanungin ng reporters kung ang 13 senador na bumoto para baligtarin ang unang ruling sa conviction threshold ay maaari nang ituring na boboto para sa conviction ni Duterte.
Noong Miyerkules, bumoto si Gatchalian at 12 iba pang senator-judges na ibase ang two-thirds conviction threshold sa bilang ng mga senador na “legally and factually” may kakayahang lumahok sa araw ng paghatol.
Ibig sabihin, imbes na automatic na 16 boto o two-thirds ng 24, ang bilang ng boto na kailangan para ma-convict si Duterte ay nakadepende sa bilang ng senator-judges na pisikal na present “as a warm body” sa araw ng verdict.
Si Presiding Officer Sen. Francis Escudero lamang ang bumotong tutol sa panukala, habang ang minority senators, maliban kay Sen. Mark Villar, ay hindi lumahok sa botohan.

Dahil nagpe-present pa lang ng ebidensya at testigo ang prosecution, sinabi ni Gatchalian na hindi pa naririnig ang panig ng depensa.
“It will be different once we get to the defense, because they will show that there is no basis for the allegations,” aniya.
