MANILA, Philippines – Tinuligsa ng kampo ni Vice President Sara Duterte ang desisyon ng Senate impeachment court na ibatay ang two-thirds vote para sa conviction sa bilang ng mga senador na “legally and factually participating” sa impeachment proceedings.
Ayon kay Atty. Paolo Panelo, paglabag umano ito sa Konstitusyon dahil malinaw na nakasaad na kailangan ang two-thirds ng lahat ng miyembro ng Senado para sa conviction.
“This is a clear violation of our Constitution because the Constitution states two-thirds of all members of the Senate are needed for conviction. They changed this yesterday,” ani Panelo.
Giit pa niya, wala umanong kapangyarihan ang Senado na baguhin ito at tinawag niyang “grave abuse of discretion” ang naging desisyon.
Sinabi rin ni Panelo na bagama’t sui generis ang impeachment court, kailangan pa rin nitong sundin ang due process at Konstitusyon. Hindi naman niya nakumpirma kung dadalhin ng kampo ni Sara ang usapin sa Supreme Court.
Samantala, sinabi ni House prosecutor Terry Ridon na malaya ang mga tumututol sa bagong threshold na dalhin ang isyu sa Supreme Court at susundin nila ang magiging desisyon nito.
“If they think they have a case, they are free to go to the Supreme Court. We will wait for that petition and whatever the Supreme Court decides, we will abide by that,” ani Ridon.
Sa ilalim ng ruling, hindi kabilang sa bilang ang mga senador na detained o suspended, hinahanap ng awtoridad at hindi matukoy ang kinaroroonan, may pisikal o medical incapacity, o wala sa saklaw ng coercive processes ng Senado. RNT/MDS
