AMLC exec pinayaganang tumestigo vs VP Sara sa kabila nang pagtutol ng depensa

MANILA, Philippines – Ibinasura ng Senate impeachment court nitong Lunes ang mosyon ng kampo ni Vice President Sara Duterte na huwag payagang tumestigo ang isang opisyal ng Anti-Money Laundering Council o AMLC kaugnay ng umano’y mga kahina-hinalang transaksyon ng bise.

Sa kanyang desisyon, sinabi ni presiding officer Sen. Francis “Chiz” Escudero na maaaring magpakilala, magpatunay, at magpaliwanag ng mga ulat ang AMLC witness na nakasaad sa subpoena.

“Section 2 of Republic Act No. 1405… separately and expressly permits inquiry into bank deposits in cases of impeachment. While this exception does not by itself dispose of the distinct confidentiality imposed on AMLC info, it confirms the policy that bank secrecy is not an absolute bar to the constitutional accountability process,” ani Escudero.

“The AMLC witness may therefore identify, authenticate and explain the reports specified in the subpoena… The motion to exclude is denied without prejudice to the counsel for respondents making any objections in the course of the testimony of Atty. Ronel of the AMLC,” dagdag niya.

Ayon sa offer of testimony ni prosecution counsel Atty. Mae Divinagracia, inaasahang patutunayan ni AMLC Secretariat Executive Director Ronel Buenaventura ang mga sumusunod:

1.     Bilyon-bilyong transaksyon umano ang dumaan sa mga bank account nina Duterte at ng asawa nitong si Atty. Manases Carpio

2.     Pumasok umano ang P1.6 bilyon sa account ng mag-asawa at lumabas ang P1.3 bilyon nang walang tala kung paano ito ginastos

3.     P4.4 bilyon na halaga ng transaksyon umano ang hindi na matunton ng mga bangko matapos ang mga correction

4.     Nagdeposito umano si Carpio ng P41 milyon na cash mula sa dalawang bangko sa loob ng isang araw

5.     Mga tseke para kay Duterte ay binili umano ng indibidwal na may kaugnayan sa iligal na droga

6.     Paulit-ulit umanong nag-flag ang mga bangko at insurance companies sa mag-asawa

7.     Pera umano mula sa China ang ipinasok sa kumpanya ng pagkain ni Carpio; at

8.     Mula 2022 hanggang 2025, halos P4.5 bilyon ang pumasok at lumabas sa 15 negosyo ng mag-asawa

Agad na naghain ng mosyon si defense counsel Atty. Mark Vinluan matapos iprisenta ng prosecution ang offer.

Binanggit niya ang Section 8A ng Anti-Money Laundering Act o AMLA ng 2001 na nagsasabing: “The AMLC and its Secretariat shall securely protect info received and shall not reveal in any manner any info known to them by reason of their office.”

Aniya, walang eksepsyon ang probisyong ito kahit sa impeachment.

“Walang tinatago ang bise presidente ngunit ang mga datos ay dapat dumaan sa tamang proseso ng pagbeberika nang naayon sa batas at hindi dapat ibalandra ang mga ito sa publiko sa pamamaraang mali, malisyoso at ang tanging layon ay pamumulitika lamang,” diin ni Vinluan.

Tinawag pa niyang “reckless and abusive” kung papayagang tumestigo si Buenaventura at sinabing lalabag ito sa karapatan ni Duterte.

“The defense is compelled to move for the exclusion of this witness, we also put on record that Vice President Sara Z. Duterte reserves the right to pursue all appropriate legal remedies against those who will violate the law in her rights thereunder,” aniya.

Ginamit naman ni Divinagracia ang mismong basehan ng AMLA, na sakop din umano ang impeachment bilang dahilan para ibunyag ang kumpidensyal na impormasyon.

“The confidentiality under the AMLA was enacted simply to complement the bank secrecy law, hence it should bow down to the same exceptions provided in the bank secrecy (law), one of which is when disclosure of info is necessitated in impeachment proceedings,” paliwanag niya.

Tinutulan din niya ang sinabi ni Vinluan na “absolute” ang pagbabawal sa Sec. 8-A ng AMLA. “If it were such, it would practically render it impossible for the AMLC to perform its functions that would necessitate, necessarily, the disclosure of information,” dagdag ni Divinagracia.  Ernie Reyes
