MANILA, Philippines – Umabot sa P193 milyon ang kabuuang halaga ng mga natatanging transaksyon sa joint account nina Vice President Sara Duterte at ng ama nitong si dating Pangulong Rodrigo Duterte sa loob lamang ng isang araw noong March 28, 2014, ayon sa mga ulat ng Anti-Money Laundering Council o AMLC.
Sa pagpapatuloy ng impeachment trial laban sa bise, tinanong ng prosecution panel witness na si AMLC Executive Director Ronel Buenaventura tungkol sa nature ng mga account na gumawa ng mga sumusunod na transaksyon noong March 28, 2014 na umabot sa kabuuang P193,705,615.88:
· reference number ending in 2490: P41,721,056.62
· reference number ending in 2540: P55,131,747.32
· reference number ending in 2510: P20,000,000.00
· reference number ending in 2500: P20,000,000.00
· reference number ending in 2480: P16,852,832.94
· reference number ending in 2520: P20,000,000.00
· reference number ending in 2490: P20,000,000.00
“The first was from former President Rodrigo Roa Duterte and Sara Z. Duterte, so this is a joint account. The second is Rodrigo Roa Duterte and Sara Z. Duterte; all of those on page 9 are under former President Rodrigo Roa Duterte and Sara Z. Duterte. And the last, Rodrigo Roa Duterte and Sara Duterte,” sagot ni Buenaventura kay prosecution counsel Atty. Mae Divinagracia.
Bahagi ang mga transaksyong ito ng P4.4 bilyon na financial movements na-flag ng AMLC sa mga ulat nito sa covered at suspicious transactions.
Sa gitna ng pagdinig, tinanong ni Senate Impeachment Court Presiding Officer Francis Escudero kung ginawa ang mga transaksyon sa parehong araw at kung “unique movements” ang mga ito.
Ayon kay Buenaventura, ang code sa covered transaction reports o CTRs ng AMLC ay “IA” – inter-account transfer. “The code po is TRIA, inter-account transfer po, CTR-IA po means inter-account transfer, so this is a movement of funds from one account to another client’s account within the same bank, Your Honor,” paliwanag niya.
“Within the same bank, but different transactions?” tanong ni Escudero.
“Yes, Your Honor, they have different transaction codes, so they are treated as unique transactions,” sagot ng AMLC chief.
Tumutol ang abugado ni VP Duterte na si Atty. Mark Vinluan sa pagpapakita ng kabuuang halaga sa Senate livestream. Aniya, walang total ang aktwal na AMLC report at maaaring magdulot ng maling persepsyon ang pag-aaggregate ng mga numero.
“Your Honor, again […] but again, Your Honor they’re already presenting an aggregate total in their presentation your Honor, particularly our powerpoint presentation, I would just like to manifest your Honor that the CTRs do not indicate any aggregate total or grand total your Honor, because it creates a perception your Honor whether it’s correct or wrong,” sabi ni Vinluan. “May we just, Your Honor, have this taken down, Your Honor?”
Pero hindi ito pinayagan ni Escudero. Aniya, malinaw sa testimonya ni Buenaventura na “unique transactions” ang mga ito kaya maaaring i-add.
Tinanong din ng presiding officer kung “double-booked” ang mga transaksyon o iisang pera lang na paulit-ulit na inilipat.
“Unfortunately, counsel, the court will allow it to stay because it’s quite clear, given the intervention of the presiding officer, that these are unique accounts in one day, and he further explained that these are mere transfers from one account to another, but that these are unique transactions,” sabi ni Escudero.
“Atty. Ronel, so these are not double-booked transactions; these are unique transactions?”
“As reported to us, Your Honor, because they have separate transaction reference numbers, Your Honor,” tugon ni Buenaventura.
Nang tanungin kung “proper” na i-total ang mga transaksyon sa March 28, 2014, sinabi ni Buenaventura: “I cannot say po you Honor, I cannot say if it is proper or not your Honor.”
“We just manifest for the record, Your Honor, that he said that he doesn’t know if it’s proper or improper, and we’ll just register a continuing objection, Your Honor,” sabi ni Vinluan.
Gayunpaman, ibinasura pa rin ang kahilingan na tanggalin ang kabuuang halaga sa livestream.
Nauna nang lumitaw si Buenaventura sa pagdinig ng House committee on justice kaugnay ng dalawang impeachment complaint laban kay Duterte.
Sinabi niya roon na nakakita sila ng covered at suspicious transactions nina Duterte at mga kamag-anak nito na umabot sa P6.7 bilyon.
Kabilang dito ang P4.4 bilyon na inflows at P1.5 bilyon na outflows.
Linawin ni Buenaventura na ang covered transactions ay mga bank transaction na lampas P500,000 na iniuulat ng mga bangko sa konseho.
Ang suspicious transactions naman ay mga hindi natukoy ang halaga pero iniulat ng bangko dahil may kahina-hinala sa pinanggalingan ng pondo.
Sa parehong araw, kinumpirma rin ni Buenaventura ang hindi bababa sa 18 transaksyon nina Duterte na nakalista sa sinumpaang affidavit ni dating Sen. Antonio Trillanes IV, na nag-akusa na may itinatagong bank accounts ang mga Duterte na hindi idineklara sa kanilang Statement of Assets, Liabilities, and Net Worth o SALN.
Nangyari ang kumpirmasyon matapos piliin ni Mamamayang Liberal Party-list Rep. Leila de Lima nang random ang 18 financial transactions sa mga annex ng affidavit ni Trillanes at ipasuri sa AMLC kung bahagi ito ng kanilang imbestigasyon.
Sa huli, kinumpirma ni Buenaventura na tumugma sa records ng AMLC ang 18 sa 18 na random na piniling transaksyon mula sa affidavit ni Trillanes. Ernie Reyes
