ABSCBN lusot sa parusang contempt sa SC

MANILA, Philippines – Ibinasura ng Supreme Court ang petition for indirect contempt na isinampa ng convicted murderer na si Datu Andal Ampatuan, Jr. laban sa ABS-CBN Corporation (ABS-CBN) at si Lakmodin Saliao, ang personal assistant ng mga Ampatuan na naging testigo ng prosekusyon sa Maguindanao massacre case.

Kinatigan ng Supreme Court En Banc ang petition for review on certiorari na inihain ng ABS-CBN at Cariño na kumukwestyon sa naging ruling ng Court of Appeals (CA) at Regional Trial Court na huwag idismis ang indirect contempt petition ni Andal.

Magugunita na Nobyembre 23, 2009, maraming armadong lalaki ang tumigil sa convoy ni Maguindanao gubernatorial candidate Esmael Mangudadatu na patungo sa Comelec para maghain ng Certificate of Candidacy.

Nasa 57 katao ang nasawi sa insidente na tinawag na Maguindanao Massacre. Sinampahan ng kasong murder ang 197 katao kabilang si Andal at kanyang pamilya.

Noong Hunyo 23, 2010, nakapanayam ng reporter ng ABSCBN si Lakmodin Saliao (Saliao) at ikinuwento nito na saksi siya nang pagplanuhan ng pamilya Ampatuan ang naturang massacre.

Pinangalanan ni Saliao ang mga miyembro ng Ampatuan na naroon sa pulong.

Dahil dito, naghain ng petisyon si Andal sa mababang korte para mapatawan ng indirect contempt sina Saliao at ABS-CBN dahil panghihimasok na ito sa court proceedings nang hindi dumadaan sa prosekusyon.

Ayon sa SC nararapat ibasura ang contempt charges ni Andal dahil sa kabiguan ng petisyon na ilahad ang lahat ng “required facts”.

“The Court held that all of the following must be alleged in a petition for indirect contempt: (1) that public statements were made regarding the merits of the case while it is pending before the courts; (2) the mental element of the speaker who uttered the contemptuous speech showing that the purpose of the speech is to impede, obstruct, or degrade the administration of justice; (3) the clear and present danger of the utterance to the court’s administration of justice, specifically identifying the importance and saliency of the information on the ability of courts to make an impartial decision; (4) the effect of the speech on the administration of justice such that the utterance will influence the court’s independence in ruling on a case, which will, in turn, affect public confidence in the Judiciary,” nakasaad sa desisyon.

Hindi isinaad ni Andal sa petition ang ikalawa at ikatlong requirement na mahalagang elemento para mapatunayan na mayroon aktwal na malisya at panganib sa justice system.

Gayunman, binigyan diin ng SC na kung sakali na naging sapat at kumpleto ang ‘cause of action’ ni Andal, maituturing sana na guilty sa indirect contempt ang ABS-CBN at si Saliao.
